Section 4. The term Improve"
and "Improvement," as used In this
Act in reference to streets, shall bo
construed to Include all grading or
regradlng, paving or repaying, macad
amizing or remacadamlslng, gravel
ing or regravellng, and all manner of
bridge-work and roadway Improve
ment or repair and all manner of
constructing sidewalks crosswalks,
sewers, gutters and curbs within any
of (he streets In The City of Pendle
ton, or any part of any such street,
and such improvements may be mad
In the following manner:
(1) The Council, whenever It may
deem It expedient. Is hereby author
ised and empowered to order tho
whole or any part of the streets of
the city to be Improved, to determine
the character, kind and extent of such
Improvement, to levy and collect an
assessment upon all lots and parcels
of land specially benefited by sueh
Improvement,' to defray the whole or
any portion oi the cost and expense
thereof, and to determine what land
are specially benefited by such Im
provement and the amount to whlcb
each parcel or tract of land Is bene
fited. (2) Whenever the Council shall
deem It expedient or necessary to Im
prove any street or streets or any
part or parts thereof, within Tho
City of Pendleton, It shall require
from the City Surveyor . plans and
specifications for an appropriate Im
provement and estimates of the work
to bo dono and the probable cost
thereof, together with a statement of
the lots, partsof lots and parcels of
land to be benefited by such pro
posed Improvement; and the percent
age of the total cost of Improvement
which each of such lots, parts of lots
