Section 4. The term "Improve"
and "Improvement," aa used In thl
Act in reference to streets, shall be
construed to Include all grading or
regradlng, pnving or repavlng, macad
amizing or remacadamlzlng, gravel
ing or rcgraveling, and all manner of
bridge-work and roadway Improve
ment or repair and all manner of
constructing sidewalks crosswalk,
sewers, gutters and curb within any
of the streets ln The City of Pendle
ton, or any part of any auch street,
and such improvement may be made
In the following manner:
(1) The Council, whenever It mar
aeem It expedient, is hereby author
ized and empowered to order the
whole or any part of the streets of
the city to be Improved, to determine
the character, kind and extent of such
Improvement, to levy and collect an
assessment upon all lots and parcel
of land specially benefited by such
Improvement, to defray the whole or
any portion of the cost and expense
thereof, and to determine what land
are specially benefited by such im
provement and the amount to which
each parcel or tract of land la bene
fited. (2) Whenever the' Council shall
deem It expedient or necessary to Im
prove any street or streets or any
part or ports thereof, within The
City of Pendleton, It shall require
from the City Surveyor plans and
specifications for an appropriate Im
provement and estimates of tho work
to be done and the probable cost
thereof, together with a statement of
the lots, parts of lots and parcels of
land to be benefited by such pro
posed Improvement, nnd tho percent
age of the total cost of Improvement
which each of such lots, part of lot
