Section 9. No bond of The City of
Pendleton, issued pursuant to the
provisions of this Article, shall be
subject to any taxation, and the nego
tiable bonds of The City of Pendleton
Issued and outstanding shall not be
taken Into account In computing the
authorized Indebtedness which The
City of Pendleton may Incur.

follows;
Section 4. The term "Improve"
and "Improvement," as used In this
Act In reference to streets, shall be
construed to Include all grading or
regradlng, paving or repavlng, macad
amizing or remacadamlzlng, gravel
ing or regravcllng, and all manner of
bridge-work and roadway Improve
ment or repair nnd all manner of
constructing sidewalks crosswalks,
sewers, gutters and curbs within any
of the streets in The City of Pendle
ton, or any part of any such street,
nnd such Improvements may bo made
in the following manner:
(1) The Council, whenever It may
deem It expedient, Is hereby author
ized and empowered to order the
wholo or any part of the streets of
tho city to be Improved, to determine
the character, kind and extent of such
Improvement, to levy and collect an
assessment upon all lots and parcels
of land specially benefited by such
improvement, to defray tho whole or
any portion of tho cost and expense
thereof, and to determine what lands
are specially benefited by such Im
provement and tho amount to which
each parcel or tract of land Is bene
fited.
(2) Whenever the Council shall
deem It expedient or necessary to Im
prove any street or streets or any'
part or parts thereof, within The
City of Pendleton, it shall require
from the City Surveyor plnns and
specifications for an appropriate Im
provement and estimates of the work
to be done and the probable cost
thereof, together with a statement of
the lots, parts of lots and parcels of
land to be benefited by such pro
posed improvement, nnd the percent
age of the total cost of Improvement
which each of such lots, parts of lots
