HAS BACK INJURED
Suffering from Injuries to his back
an Italian laborer, known as Tony,
was brought to St. Anthony's hospital
from Twohy Brother's Barnhart camp
this morning. It seems that a dump
car fell off the track and onto him
while he was standing with his back
to the track.
The Injured man was met at the
depot by Dr. Waffle and taken to the
hospital. Apparently he was In great
pain but as the Italian laborers are
in the habit of making a great fuss
over the slightest Injuries, it was im
possible to tell how badly he was hurt.
It is not believed, however, that his
Injuries will prove fatal.
Another Injured man by the name
of Bingham was brought up from the
Coe camp yesterday. He had had the
end of his thumb pinched off between
a couple of steel rails. He is also be
ing cared for at the hospital.
RUSSIAN' TERRORIST
FACES MURDER TRIAL
been circulated about King George's
addiction to strong drink to d-.e
down. These stories have been re
peated from one to the other for sev
eral years past, and only the mem
bers of his household, who in duty
bound repeated the stories to their
nir.ster, know what Intense pain they
have caused the new king. So serious
a view has now been taken of these
stories that the dean of Norwich, who
has been intimate with the king for
years, felt himself compelled the oth
er day to deny them with great f jrce
from the pulpit, and Lord Uosebtry
has, as delicately as possible, donj the
samethlng both in public and in pri
vate. In the past six or seven years Ivlnp
George has suffered acutely from in
digestion. His nose becomes red im
mediately after eating and his eyes
water, which gives him just the ap
pearance of a man who has been
drinking. This is considered by his
intimate friends to be the only pos
sible explanation of the storing which
have been circulated with so many
circumstantial details.

Paris. The Russian terrorist,
liichael Rips, is on trial before the
Paris Assize court for having attempt
ed to murder Colonel Kotten, chief of
the secret police of Moscow, in a Paris
hotel a year ago.
Rips, who was engaged in several
terrorist plots, was arrested and sent
to Siberia in 1906. He escaped, re
turned to Moscow, was arrested again,
and was offered a tree pardon by
Colonel Kotten if he would enroll
himself in the police and betray his
comrades.
This he pretended to do and he
came to Paris nominally to serve the
Russian police, but really In the in
terests of the terrorist party.
On May 8 last year Rips had an
appointment with Colonel Kotten, who
had come to Paris to see him.
Going to the colonel's hotel in the
Rue Bi'Iivar, Rips fired at him re.
peatedly. All the shots missed the
colonel, and, the revolver being empty.
Rips then attacked the colonel sav
agely with the butt end of the weapon.

RAINIER SHOWS RESPECT
FOR DECEASED CITIZEN
London. Some interesting state
ments were made at the annual dis
tribution of prizes and medals to the
British messenger boys the other day
at the Mansion House by the Lady
Mayoress.
Several special prizes were present
ed. A bov named Bevan received one
for making a quick journey from
London to Amsterdam and back with
two crates of rubber prospectuses. An
other named Collins was run over by
a taxicab in Piccadilly, and when
taken from under the wheels his first
thought was of his package, which he
gave to a policeman.
Mr. George Manners, the general
manager, said that not long ago a
messenger boy was called to a lady
in a Bond street house and when he
go there he found the lady standing
on the table in the middle of the
room. She said that she could not
come down because there was a
mouse in the room and she wante.1
the boy to catch it.
Rainier, Or. The funeral services
over the body of John Dibblee were
held at the family residence at 9
o'clock Thursday morning. Rev. Mr.
Clapp of Portland, officiating. Beau
tiful floral offerings filled the room
in which the services were held, and
old residents from all parts of the
county were here to attend the funer
al. Out of respect for the dead, all
business houses were closed for the
morning. The body was shipped to
Portland on the 10:30 train to be
placed In the family vault.

With but four of the regular team
men as a nucleus, Manager Prazler
of the Pendleton Colts yesterday went
to Walla Walla and retrieved the hon
ors lost on the local diamond a week
ago. As tho majority of the team
members were absent from tho city,
Frazier was forced to recruit men
from Athena and the Garden City gar
rison to fill his depleted ranks to the
required number. Plcard. Do Peat
and I.ieuallen were picked up from
tho former town and Calllhan and
Kinney were annexved from the army
artists. y
The final score stood 6 to 6 In fa
vor of tho pickups, although from the
third inning Pendleton's hold on vic
tory was slipping, ana, had the con
test gone a few more cantoes, the
Walla Walla bunch would undoubted
ly have had tho marginal score. The
game was won in the first Inning
when tho Oregonians chased four run
ners over the pan. Von Nahmen was
weak then and besides allowing four
hits, was wild and gave a few free
passes. Pendleton secured one more
in the second and one in the third
but from then on did nothing in the
line of baserunning. Walla Walla,
on the contrary, gained her balance
in the fourth and kept up her scor
ing until the ninth, at tho end of
which only one run was lacking to tie
the score.
Pieard, the Athena t wirier, was In
the box for Pendleton, and, although
he worked hard, ho was out of train
ing and only came through without
losing his scalp by the gilt edge sup
port of his teammates.
DePeat, Leonard ana Calllhan es
pecially did notable work In prevent
ing runs.

NIGHTINGALE'S SONG
SUBJECT OF DECREE
Vienna. The highest court of ap
peal in the Austrian Empire, after
months of litigation, has decided that
the song of a nightingale Is not a nui
sance A citizen of Gratz, Herr Helnzel,
keeps a nightingale in a cage, and on
fine nights hangs It outside the win
dow. A neighbor complained to the
police authorities that the bird's
song disturbed his slumbers, and the
municipality ordered the owner of the
nightingale to keep it inside the house
at night. Herr Helnzel again appeal
ed against his order to the govern
ment of Styria and then to the min
istry of the Interior, but both these
administrative authorities refused to
Interfere with the decision of the
municipality.
Undismayed by the costs incurred,
Herr Helnzel then appealed to the
court of administration, which has
jurisdiction over the highest execu
tive and administrative functionaries.
Five Judges, Including the president.
Baron Schenk, gave a learned judg
ment in favor of the owner of the
nightingale on grounds which
amounted to saying that the song of
a native bird like the nightingale was
a natural sound which nobody had a
right to object to, whether he liked
it or not.
