terday: An ordinance grouting to Max
Haumelstcr of Walla Walla and hln
successors ancl assigns, a franchise to
construct, maintain and operate an
electric railway for the transporta
tion of freight and passengers for
hire on and over certain streets In the
city of Pendleton In the state of Oe
gon, and to construct and mnlntaln
a syHtem of poles and wiring for the
transmission of electricity and to
conduct the electTlc current thereon
within the city of Pendleton for com
mercial purposes.
The people of the city of Pendle
ton ordain as follows:
Section 1. That Max naumeister,
of "Wallu Walla., his successors and
assigns, be and It Is hereby empow
ered and authorized to construct,
maintain and operate a modern,
standard guage, electric railway, with
the necessary Hidings, turnouts and
switches, to be operated by electricity
or other power, except steam power,
for the carrying of passengers and
freight for hire along and .over the
following streets: Court street, Alta
street. Walnut street and Benefit
street, anil over such other streets
as the said Max Tlaumelster or his as
signs, select, and do all the necessary
alterations, excavations and filling for
such purposes.

powered to set the necessary poles
and string the necessary wires In
such manner nnd at such places In,
along and over all the streets, alleys
and sidewalks In the city of Pendle
ton for the uses of such railway and
for the transmission of electricity and
do all necessary In the premises forj
the construction, equipment and op
eration of said railway, and for the
transmission and distribution of elec
tricity for the operation thereof nnd
fur power anil lighting purposes gen-j
crnlly within the limits of the city
of Pendleton, and shall have the
right to transmit electricity over
such wires nnd sell the same to any
and all persons nnd concerns and re
ceive payment therefore.
Section 2. The tracks of said trac
tion company shall be laid over the- j
streets. of the city of Pendleton so asi
to conform to the established grade
of the city and under the supervision
and approval of the common council,
nnd the poles for said railway shall
be set anil erected and wires strung
tinder like supervision, and In no In
stance shall such poles be set In the
center of any street of the city.
Section 3. When the city, for Im
provement purposes, shall require the
temporary removal of any part of
said railway tracks, wires or poles)

year and six months from the taking
effect of this franchise as hereinbe
fore provided, then this said fran-j

council, be declared null and void.1

a labor famine that threatens to re

says a Lewlston Item.
The pench crop Is just now com
ing onto the market In large quanti
ties, nnd by the middle of next week
1000 pickers and packers will be re
quired to handle the fruit. A can
vass of the situation hns convinced
the growers that very few unemploy
ed people are available In this sec
tion, and an effort Is being made to
secure help from the Potlatch and
Pa louse sections.

$1 75 to $3 per day and because of

Section 7. The cars of said trac
tion company shall not travel at a
greater speed than 12 miles per hour
within the city of Pendleton, and It
shall haul no freight cars, except for
express and mail carrying purposes,
over Its tracks within the city of Pen
dleton between the hours of 7 o'clock
a. m. nnd S o clock p m., except as
herein provided or by special per
mission of the mayor of the city of
Pendleton.
Section S. The grantee or his as
signs shall have the right to lay and
mnllitaln Its railway tracks across
the tracks of any other railway at
such points within the city of Pen
dleton as It may find necessary for
the effective construction and opera
tion of Its own railway and to main
tain the same during the life of this
franchise.
Section 9. The grantee or his as
signs shall have the right to permit
cars of any other connecting line or
traction company to operate over any
part of Its line nnd may collect a rea
sonable charge therefor.
Section 10. The grantee hereby'
agrees for himself and his assigns to'
protect and save harmless the city of
Pendleton from all costs, claims and
damages of every name nnd nature
which may accrue to It by reason of
the construction, maintenance nnd
operation of the railway, power and
lighting systems herein authorized.
Section 11. Any person wilfully
