The legislature of 1907 passed a
new law on the subject of burning
slashlngx. In view of tho fact, con
siderable Inquiry has been made to
this office on the subject Tho fol
lowing section Is given In full oh the
matter of burning" bush; .the law of
1947. unge 242. section 5, reads as
follows:
"During the period between June 1
ami Actober 1, which Is hereby deS'
iKiiated the close season, It shall be
unlawful for any person or persons
to set on fire or cause to be set on
fire any slashing, chopping, wood
land or brush land, either his or their
own or the property of another,
without written or printed permission
from a state fire warden and com
pllanco with terms thereof.
This restriction shall not apply to
the burning of log piles, stumps or
brush heaps, In small quantities at a
safe distance from other lnflamable
material, and under adequate precau
tion and personal control, and In ac
cordance with regulations adopted by
said board; but If any such burning.
without permission, shall result In
the escape of the flro and Injury to
the property of another, this shall be
held prima facie evidence that such
burning was not safe, and was a vi
olation of this section.
"Violations of these provisions
shall be punished by a fine of riot
less than twenty-five (25) dollars nor
more than five hundred (500) dollars
or by Imprisonment or not less than
10 days nor more than three months."
lVrnilts to burn, provided by this
section, may be Issued by any state
firi' warden, and shall contain such
restrictions ns to time of burning, and
precautions to be taken, as may be
fixed bv the state board of forestry
or left by said board to the dlscre
thm of fire wardens. Any fire warden
shall have the right to refuse, revoke
or postpone permits when It Is clear
lv necessary for public safety. Any
npplleant dissatisfied with the deel
slon of a state fire warden shall have
the right to appeal to the state board
of forestry. Any permit obtained
through wilful misrepresentation
sliall be Invalid and give no exemp
tion from liability of any kind.

It is announced, however, that the
offense Is against the United States
army under the Dick law, and will be
settled by the war department and not
by the state of North Dakota.
Negroes Prosperous.
Baltimore, Aug. 20. Reports from
state organizations of colored people,
presented today .at the convention of
the National Negro Business league,
show a considerable gain in the num
ber and extent of business enterprises
conducted by negroes. Colored men
from many states took part In a
symposium on "What Negro Business
Men Have Accomplished."
Big Fine Rehearing.
Chicago, Aug. 20. Petition for a
rehearing by the United States court
of appeals of the government's suit
against the Standard Oil company of
Indiana, in which the appellate court
reversed Judge Landis' fine of $29,-
240,000, will be filed here tomorrow.
The document will bo filed by Uni
ted States Attorney Edwin W. Sims,
acting under the direction of Attorney-General
Bonaparte.

Santa Rosa, N. M., Aug. 20. One
man Is dead and two are fatally in
jured as a result of a premature ex
plosion of dynamite, being lowered
Into an oil well near here last night,

blown 30 feet unhurt.
Thirty Acres of Canteloupes.
Approximately 30 acres of the Lew
iston orchards are this year devoted
to the cultivation of canteloupes, and
the first shipment to the outside mar
kets will be made today by A. H.
Duffy, says the Lewiston Teller.
Mr, Duffy Is cultivating five acres
of melons, and will make first ex
press shipments into Spokane and
Montana markets.
Within a few days it Is expected an
arrangement will be .made by which
the Orchard Tract growers will com
bine their shipments and send the
canteloupes into the outside markets
in carload lots. The crop Is most
profitable and the 30 acres are esti
mated to produce about 20 carloads.

out from Pasco of looting of restau
rants was overdrawn and has placed
the North Dakota guard la an unjust
light.

A new stacker, which is being op
erated this season by Franz Romalne
Is attracting a great deal of attention
among farmers of this vicinity, says
a Dayton Item. With the new stack
er, which was modeled by Mr. Ro
ma in e, it is possible to build a stack
20 feet in height and to greatly fa
cilitate the work. The grain la rolled
off the wagon and It Is claimed does
not shatter a particle. Two men are
required on the stack. Those who
have seen the machine In operation
claim it superior In many respects to
any stacker yet operated.

Fourth on Lists.
In the championship regimental
skirmish match of the National Rifle
association tournament yesterday 40
teams competing, the Fourth Oregon
regiment won tenth place, says an
Item from Camp Perry. Only three
state organizations, Oklahoma, Mas
sachusetts and Colorado, made higher
scores than Oregon.
Three Important matches were,
scheduled for yesterday, being the i
regimental skirmish, the Wimbledon j academy (second team)
cup shoot and the regimental team
match. The team match was only J
partly finished, and the Wimbledon
cup shoot was put over until tomor
row. In the skirmish match between 40
teams of six men each, the regulars
took the first three places, the hon
ors going to the corps of engineers,
with a scoreof 440; thearine corps
was second, with 403, and the naval
academy third, with 398. The cavalry
teams shot for practice . and made
have given the cavalry second and
fifth place.
The Second Washington, which was
first last year, finished 15th yester
day. This event must be won three
years In succession before the cup
can be held.
The scores In the regimental team
match were not complied tonight by
the officials and the standings are
not known.
