Suit to collect $451.45 alleged to be
due from Sadie Rust was brought
this morning by the Standard Gro

claimed to be due the grocery com

In an open letter to the city coun
cil Ross Newport, superintendent for
the Newport Land & Construction
company, offers to give $100 to char
ity if he cannot prove that his bid on
the levee work was the lowest sub
mitted and upon the strength of his
claim he asks that the council again
ask for bids upon the levee, work. .
As the council meets tonight to rat
ity the contract with Betts, to whom
the contract was awarded by the levee
committee, the letter is of Interest
and is hereby given In full:
A open U tter to the City Council of
Pendleton.
Gentlemen: Almost two years ago
your city advertised several times for
bidders for the levee repair work
which was badly needed for the pro
tection of your city. Xo satisfactory
bids were received. It was recognized
as a hard job and being late in the
season contractors of any ability, re
fused to look at It. Late in Septem
ber our concern was urged by the
chairman of the levee committee to
make a price on this work. We re
fused to do so at first, but after re
peated solicitations on the part of the
committee and other prominent citi
zens of Pendleton, we madf a proposal
which was readily .accepted. We did
the work, and whether satisfactory
we leave it to any citizen of your town.
-Mr. Keisey or loung & Kelsey, en
gineers in charge, pronounced it a
most satisfactory Job. Several other
civil engineers who Inspected the rip
rap said they had never seen better.
And another matter due your consid
eration Is the fact that after the work
was completed we were compelled to
carry a large sum of our pay In city
warrants t'hat we could not negotiate,
as your banks were already loaded
with such paper. Part of these war
rants we held for almost a year be
fore we secured the money therefor.
Another matter that we desire to
call your attention to is the fact that
we are a home product. We are a
Umatilla county, Hermiston-Pcndleton
contracting company, built up at
home. We purchase a large part of
our supplies of your city merchants.
We employed many of your citizens
who always got their pay for work
performed. We consider our company
a credit to the county of Umatilla, as
It Is, the largest and best organized
contracting concern In the state of
Oregon east of Portland today. And
we have always been on the square In
any contract we have ever undertaken
and can refer to such men as W. J.
Furnish, and to your street commit
tee, about our repairs on Court street
which our contract did not require us
to do. We gave no guarantee on such
work, but we came back and have
made an excellent street of East Court
at an expense of several hundred dol
lars to us, because we always made
good on anything we undertake.
We have mentioned this to show
that our ability and reliability has
never been questioned and we could
not be turned down on any such ac
count Now we will proceed to present the
matter of levee bids. There seems to
be a great many "holes in the skim
mer." We claim that we had the
lowest bids on the levee work when
the bids were opened on the 24th Inst.
Furthermore, we will make this offer,
viz.: If we cannot show to any dis
interested civil engineer or reliable
contractor" that our bid was from one
to two thousand dollars lower than
any other bid submitted for the entire
work we will donate $100 to any
charity that the editors of the Tribune
and East Oregonlan may select.
The bid of our principal competitor
was made for riprap 98 cents per
square yard. He did not bid on old
riprap or new riprap, but Just riprap,
and we want to know if there Is any
one foolish enough to suppose for a
moment that the bid was not Intended
to cover all riprap at this price? A
little figuring will show the differ
ence this little matter makes. Add to
9500 square yards of new riprap 4000
yards of old riprap and you have a
total of 13,500 Bquare yards of riprap
at his bid of 98 cents per square yard,
means $13,230. Now take our bid on
9500 square yards of new riprap at 90
cents, which Is 18550, and 4000 square
yards of old riprap at 45 cents, which
is $1800, making a total on new and
old riprap of $10,350. After the prop
er deduction Is made you will find a
difference In favor of our bid of
$2880.
Now we will go a little farther:
The specifications In reference to ex
cavation says that whenever the ma
terial excavated from the trench for
the toe wall can be used In the em
bankment, within the distance of 100
feet, it will be paid for In excavation
only, but Mr. Betts In his bid says
plainly that he will make no reduction
on account of using gravel In levee
from excavation. We make no such
reservation but made our bid In ac
cordance with the specifications and
expected that at least 4000 cubic yards
of this material would be put Into the
embankment without extra cost to the
city. Now suppose you take this 4000
cubic yards and multiply it by his
lowest price per yard for excavation
or 33 cents you have $1320 which up
on being added to the balance already
li our favor makes $4200.
But we will not stop here. We will
now take up the matter of (tone ma
sonry. The committee estimates this
at 200 cubic yards. Mr. Brink, a re-.
liable mason, bid 23 cents per cubic
foot, which amounts to $8.21 per cu
bic yard. Our "bid was $3.95, which
makes a difference of $2.26 in our
favor and estimating 200 cubic yards
amounts to $442 In favor of our bid,
and when added to our previous bal
ance makes $4642. Now, while I am
not from Missouri, I would, neverthe
less, like to be shown how the com
mittee could turn down Mr, Brink's
bid and allow Mr. Betts to come In a
day later and make a bid on stone
masonry as they did, as well as bid
ding 2 cents per square yard less than
our bid on old riprap T
There are several matters that need
explaining to Mr. Brink and ourselves
and the public. We admit that our
competitor had a lower bid on em
bankment, excavation and toe wall of
approximately $1800, but what are
you going to do when you deduct
$1S00 from $4642 which leaves a bal
ance still In our favor as lowest bid
der of $2842." Now If we cannot make
rood In this matter you can have $100
to be given to a Pendleton charity, ui
course If Pendleton Is going to De a
dead town and never have any more
public work done, and will never need
any more bidders on work, it doesn't
make any difference how bids are
Juggled but If you expect to be a live
city and go on with civic improve
ments you will need reliable bidders
and you will find them wise as to how
thinss are done.
There Is one other matter that I
wish to correct and that Is this:

took in the anti-saloon fight in our
county. This I did not say, but now
I want to say that a good many signs
are so plain that those who run may
read.
Now in conclusion will say that I
do not wish to cast reflections on the
members of the city council of Pen
dleton. I would rather think that they
had a misconception of the facts in
the case and I believe that after the
matter is gone over and things are
seen In their proper light they will
favor the calling for new bids and In
so doing let us all get down to straight
forward basis and make bids plain
and clear and let the longest pole
knock the persimmons.

matlon that Montie B GwJnn of Pen
dleton, has been elected president of
the Oregon State Bankers' assocla
tion which has just closed Its annual
session.
This is a high compliment paid to
a former citizen of Idaho which will
be greatly appreciated by his friends
in this state.
Yet It comes as no surprise to those
who have known that Mr. Gwlnn al
ways "makes good" wherever he may
be. His Idaho experience and suc
cess guaranteed that he would be
successful at Pendleton where he has
located.
Beginning ' in this state years ago
in a -modest way, he built up one of
the most flourishing business house
in the state. He always took a most
active Interest In the advancement
of the Interests of his community and
of the state at large. He was a di
rector and stockholder for a number
of years In the First National bank
at Caldwell and a director and vice
president of the Caldwell Banking &
Trust company of the same city, two
of the best banking Institutions of the
state. i i
In addition to this Mr. Gwlnn was
a stockholder in a number of smaller
banks throughout this state and east
ern Oregon before leaving Idaho.
He successfully managed the best
meeting the National Irrigation con
gress ever held at its meeting In
Boise, has held all the principal offi
ces of the Odd Fellows and Knights
of Pythias of this state, having been
grand master of the Odd Fellows and
grand chancellor of the Knights of
Pythias, besides representing both or
ders in their supreme bodies.
In short, in every line of activity
ever undertaken by him, he has al
ways been found sooner or later at the
top, and accordingly it comes as no
surprise that the bank fraternity of
Oregon soon recognized his worfh and
honored him with the selection as
president of their state association

Conductor Charles H. Norrls of the
Pendleton-Huntington passenger run
on the O. R. & N., has just sold his
residence In La Grande for $2400 and
will reside permanently In this city.
Conductor John O'Connell of the La
Grande freight division, -who lost both
of his legs under the wheels of his
caboose some months ago, was the
purchaser. Mr. O'Connell will en
gage in business In La Grande.
