The Western Union Telegra
company is installing: the Darclay
printers on its trunk lines, which may
aid the railroads In meeting the exi
gencies of the nine hour law by other
means than closing up depots be
cause telegraph operators cannot be
secured in sufficient numbers, says
the Cheyenne Tribune. The Barclay
machine does the work of three or
four operators.
The machine Is operated by tape
and sends out about 100 words a
minute, which are taken automatical
ly on the receiving ond of the wire by
a machine similar to a typewriter,
which writes the messages on the
regular receiving blanks of the com
pany. The tape is prepared by means
of a machine which also works like
a typewriter, but which perforates the
tape similar to the Wheatstone system
now in use in this country and Eu
rope, the charncters, however, being
different
The Barclay printers differ from
the WheatHtono syxtcm in that at the
point of destination Instead of the
mesrage being received on a tape In
telegraph characters It is printed by
the receiving machine on the blanks
of the company ready for delivery.
The machinery works automatically
and, as one machine transmits aa fast
as three or four operators, it saves
many men at each end of the wire.
When a message Is taken Into one
of the larger orrices It will be tran
scribed by a machine onto tape In
character, then placed In the send
ing ms chine, which sends it automat
ically aa described above.
The Barclay system is quite new and
has but recently been put In use be
tween large commercial centers In the
east. tt Is now being Installed In Kan
Baa City, Omaha and St. Paul, con
necting them with each other, as well
aa with Chicago. The system Is con
sidered a great success by the West
ern Union company, which owns and
controlls the patents.

pressed. with the utmost dispatch.
Men and teams will be put on the
work down the river as fast as they
can be obtained and the belief Is ex
pressed by railroad men here that-tho
work will now continue steadily until
the road Is completed,.

Seattle parties are endeavoring to
get the land owners about Two Rivers
to contract to plant at least 1000 acres
In asparagus, and agree if that acre
age can be secured to establish an
asparagus cannery at Two Rivers.
The Two Rivers Investment company
will have the matter of contracting
In charge, and It Is hoped that the
required acreage can be secured. It
will mean the establishment of an in
dustry at Two Rivers, that will em
ploy a large number of people. This
soil Is adapted to the growth of as
paragus, and is very profitable to the
gardener. From 1000 to 12000 gross

The exact route, so far as North
Yakima Is concerned, of the Pacific &
Southeastern railroad, the new road
which has been capitalized at 115,000,
000, to build from Tacoma to Walla
Walla, as announced In Its articles of
Incorporation, Is as follows, after leav
ing the mines at Wilkeson, says the
Yakima Republic:

One of the most important ques
tions affecting the grazing of sheep
on the public domain ever presented
to the supreme court of this state was
decided this morning by the court's
ordering a new trial for Paul Richter,
a Big Horn county sheepman who was
found guilty of a misdemeanor and
fined 150 In the district court of Big
Horn county, the offense being the
breaking of a quarantine In which
his sheep had been placed by a state
sheep inspector, says the Wyoming
Tribune. The inspector had previous
ly Inspected the sheep and found
them to be without disease, but hav
ing heard that the sheep had been
exposed, quarantined them on sus
picion. This quarantine Rlchter's
herders broke Immediately and con
tinued to graze . the sheep on the
open range.
In his trial the Judge made certain
instructions were such as to make hit
conviction certain for the fact that
he had broken quarantine, regardless
of the reasons which he might have
had for breaking quarantine.
The court holds that there is no
question of the right of the state In
spector to quarantine sheep which
are diseased or which have been ex
posed to disease, this being the only
way In which the state can enforce
rolico regulations to prevent the
spread of 'disease among sheep.
But the court further says: "We
doubt If the legislature has the pow
er to lodge In one man or set of men
the authority to deprive a man of his
right to the control and custody of
his sheep because the inspector or
any one else suspects they are infect
ed with scab. The inspector has the
right to Inspect the sheep and if
competent to do so, It Is an easy mat
ter for him to determine whether they
are Infected or not."
The court held that yie instruction
of the district court to the Jury to
the effect that the Insuector has the!
power to quarantine sheep which are
merely suspecter of being Infected
with disease is erroneous, as the stat
utes (20SS) confers no such power.
"And it is not always true," sayi
the decision referring to another In
struction of the lower court which Is
also decided to be error, "that the
owner of sheep who removes them
beyond quarantine limits prescribed
by a lawful Inspector and yet if he
acts beyond and outside of the au
thority reposed In him his acts are
void for in such case he has no Jur
isdiction to act."
The court also denies that in cases
where the inspector merely suspects
that sheep have been exposed, that
he is the sole Judge, and that if there
had in reality been no exposure to
disease, the quarantine set up by the
Inspector was unlawful and there was
no offense committed in breaking it
The decision of the district court
is reversed and a new trial ordered
principally on the ground that the
Jury was Instructed that the Inspec
tor's right to quarantine was abso
lute, and gave the defense no oppor
tunity to Justify his breaking the
quarantine by showing that his sheep
had never been exposed.
