ar.d state will be asked to supplement
tne subscriptions of the farnmrs in
this vicinity who are raising money
to repair the banks of the Thm-a-lum
and Walla Walla rivers, who are in.
terested In controlling the flood
waters, which are doing considerable
damage to the ranches along the
river.
About 12000 has been subscribed
for the project, and the work of dyk
ing the river has already commenced.

The young men of Freewater are
arranging to organlxe a baseball team.

Milton. April 3. Mrs. Jean Morris
Ellis, the phrenologist, has given a
few lectures here this week which
have been enjoyed by many of the
Milton people.
T. T. Geer has been here this week
in the Interest of his congressional
race.
P. H. Smith has Just completed the
sale of a small tract of land In Gross
addition to J. B. Smith, for $600.
The city of Milton recently purchas
ed a tract of land on which is located
Severai springs, and has 610flVi!tp4 a
reservoir and developed a splendid
spring at a point far enough above
town to give a good pressure for fire
purposes, and the city will be furnish,
ed from these springs for domestic
purposes. The city has received re
ports from samples sent to the state
bacteriologist and the state chemist,
showing that the spring water Is of
the most wholesome for drinking and
all purposes.
This gives Milton one of the best
water supplies In the state of Oregon.
A new fraternal society has been
added to mllton's already large sup
ply. The newly organized lodge Is
the Royal Neighbors, auxiliary to the
Modern Woodmen. The charter mem
bership numbers 25.
J. E. Cherry has returned from a
trip of several weeks to Gilliam
county.

Big Irrigation Project to Reclaim
Idaho Land.
The American Falls Canal & Power
company has made application for an
acre-foot of water for every acre
tinder the Carey project here, from
the government reclamation reser
voir at Jackson's Luke, says the
American Falls Press.
This, water is additional to the water
right sold by the company, Dut u 18
not Incumbent upon any lam? owner
to purchase It unless he so desires.
The system Is being put In by the
government to insure against possible
unfavorable years. The water will be
sold at actual cost, which Is estimated
at from 80 cents to $1 per acre.
The government is building an Im
mense storage reservoir, holding the
flood waters of the early spring
months, for use in the late summer
and fall. The Twin Falls and other
systems will use water from the res
. rvolr. The American Falls company,
however. Is the first to make appli
cation. The water will be sold In Install
ments and If the cost Is $1 per acre,
will amount to only 10 cents an acre,
for 10 years, without Interest. There
Is little probability that It will ever
be needed, but It Is such cheap Insur
ance that most land owners will prob
ably buy It.
The water rights provide for the
delivery by the company of two and
one-half acre-feet per year to the
land. This is for the Irrigating sea
son, covering about six months, which
U about double the rainfall of the
Mississippi valley, which will be read
ily understood as being ample for all
purposes.

Protecting Legitimate Real Estate
Dealers.
Judge Burnett made an Important
ruling yesterday affecting the city
ordinance relative to the licensing of
real estate brokers. The rule an
nounced was In the case of S. Page,
plaintiff, vs. C. W. Brasher, defend
ant, wherein plaintiff brought an ac
tion against defendant for a real es
tate commission amounting to $306.

er appeared by his attorneys, John
H. and C. L. McNary, and filed an
answer alleging among other things
that the sale was made within the
corporate limits of Salem, and that
the plaintiff had not complied with
the city ordinance In that he failed
to procure a license to sell real es
tate and therefore could not main
tain an action to recover his commis
sion
T!.e plaintiff, through his attorney,
Mr. Pogue, filed a demurrer to the
answer upon the ground that the or
dinance was defective In that the
legislation did not delegate the au
thority to the city to Impose a tax
upon real estate brokers and that the
ordinance imposed a tax rather than
a license
The case was argued some time ago
and taken under advisement and de
cided by the court yesterday. The
demurrer was overruled which holding
sustains the city ordinance and makee
It legally Impossible for a real estate
man to recover his commission unless
he has a license from the city.
The validity of the ordinance hns
been questioned for some time, but
yesterday's ruling removes all doubt.
The decision Is a body blow to the
"curb-stoners," whose only offices are
on the street corners and who pay no
license and usually not a great deal
of taxes

game of baseball originated in the
mind of the late General Abner Dou
bleday would have Immensely sur
prised that old warrior, perhaps, had
he lived to enjoy such unexpected
honors. That he originated the
game cannot, of course, be affirmed
with the utmost confidence, for the
testimony gathered by the special
committee, whose report Is printed
in Spauldfng's baseball guide for the
present year, scarcely pretends to do
more than affirm that the most ex
haustive Investigation carries the
game no further back than young
Doubleday's performance In marking
out a diamond for ball players about,
the year 1839.
That he did this one day Is the evi
dence of an elderly Individual who
claims to have been present at the
time, and whose veracity and com
petency as a witness the committer
unreservedly acknowledges. That the
Idea of the diamond, the salient struc
tural characteristics of baseball, would
have hud Its birth In the military
mind of one like Doubleday is argu-
