Tom Tucker and a follow named Borcnn, are wanted In Wallowa coun ty for assault on the person of one William Estes of Joseph. About week ago a fight ensued at a dance near Joseph, In which Tom Tucker and Boggan were two or the princi pals. The next morning the two men went to a sheep shearing camp about seven miles northwest of Joseph, and there saw a relative of the man whom they had been fighting the night pre vious. Without any reasons, und ap parently with Intent to kill, Tucker bounced upon Estes and soon had him down on the ground. While sitting on his antagonist. Tucker commenc ed to beat Estes about the head with the butt of a revolver. The father of Estes rushed to the rescue of his son, and In the secondary Bcuffle which fol" lowed, the revolver was either acci dentally dlflchnrgcd or purposely so, nnd the bullet entered the right hip of Estes, tearing a frightful wound In the thigh. A brother of Tucker has been arrested, charged as an acces sory In the assault, but the authorl i,.u nr.. nnnhle to lay hands on either Tom Tucker or his pal. Bogxan. Elsewhere In this Issue Is a state ment of a recent purchase by Joseph Barton, superintendent of the Sumpter . Valley railway. Now the Information Is at hand that Mr. Barton has tender ed his resignation with the railroad concern and that the same Is effective ' on next Monday. Thnt there has been ' some kind of a move In the Sumpter ' Valley affairs leading up to this has been patent to quite a number of peo ple for somo time. Mr. Barton was here on Thursday, but said nothing of the matter and It had not leaked out so that the Baker papers had cognis ance of It up to yesterday. Jesse I. rtearns of the Deschutes Ir rigation & Power company, and John Steldl and J. E. Sawhlll of Bend. The news was given to the public at 11 o'clock today at a mass meeting called In the B. M. hall, when Mr. Sawhlll stated the above facts. He announced further that the D. I. & P. company will move Its headquarters back to Bend In the Immediate future, and will do all It can to help In the growth of Bend. The above news was received gladly by the assembled citizens. It assures that the unfortunate troubles which have existed between the Deschutes Irrigation & Power company and the Pilot Butte Development company for the past two years will now be a thing of the past and that the devel opment of this region will go for ward without the retarding friction that has heretofore existed. Bend Bulletin. Scab In Adnma and Franklin. All of the sheep now being driven to the Bitter Root forest reserve for summer range from central Idaho and eastern Washington are being ad mitted without the dipping with the exception of .Adams and Franklin counties, where large numbers have been dipped during the past few weeks. Dr. C. Lv Henderson, stock Inspec tor for eastern Washington and cen tral Idaho, has recently returned from a trip of Inspection to Adams and Franklin counties and directed the dipping of 20,000 sheep while there. Dr. Henderson states that large num bers were dipped by parties from Wal es. Walla and Pendleton and It Is be lieved the scab will be entirely eradi cated from those cpuntles within a few years. The scab has been eliminated from Nes Perce and Idaho counties and a number of eastern Washington coun' ties and In these counties which have been declared free from scab, the owners of sheep are admitted to the forest range with their bands without dipping. Jacobs, a saloon keeper of Wallace, in the county of Shoshone, will be brought before the supreme court In response to a writ of habeas corpus Issued by the court In special session yesterday, which commands the sheriffs of Shoshone county to appear with Jacobs so that the court may determine whether or not he Is being unlawfully Imprison ed In the county jail of Shoshone county for violation of the Sunday rest law enacted by the last Idaho legislature. This case will bring the validity of the Sundoy rest law before the su preme court at an earlier date than the Dolan case, which Is now pending before the district court of Ada coun ty, as it Is on the grounds of the un constitutionality of the act that Jacobs petitions the supreme court for a hearing. The petition for habeas corpus re cites that Jacobs was convicted In the probate court of Shoshone county of violating the provisions of the Sunday rest law by keeping his saloon open on Sunday, June 23, at Wallace. In his petition Jacobs, by his attorneys. represents that the Sunday rest law Is unconstitutional and void for the reason that It conflicts with the pro visions of section 18 of article S of the state constitution, In that the title of said act Is misleading, ambiguous and uncertain. The petitioner further represents that the reason, why the application was made to the supreme court Is be cause the question of the constitution ality of the act Is involved In the ap plication, nnd because W. W. Woods, Judge of the first Judicial district, is now absent from Shoshone county. The petition calls attention to the recent decision of Judge Fremont Wood In regard to the demurrer In the Dolan case, now pending In his court, In which he expressed his doubt of the constitutionality of the law.
