By on. of them the will of the late Mr. Cynthia A. Turner was upheld, and In the other cut, that of El L. Smith versus the Interior Warehouse company, a de cree In favor of the company was lTM. 'I KIHAiai The Turner will case is one that has been fought out at length both In the county and circuit courts here. After a lengthy trial In the county court Judge' Gllllland ruled in favor of O. C. Turner and other, who were the beneficiaries under the will. The case was then appealed to the cir cuit court, and the case was argued very extensively br the attorney, two weeks ago. After having the matter under consideration for 10 days, dur ing which he perused 600 pages of the transcript testimony. Judge Bean gave his decree this morning. The suit of & U Smith versus the Interior Warehouse company, arose over the former's refusal to deliver all of a consignment of wheat sold the company at a stated price. By the terms of the deal with the com pany, Mr. Smith agreed to deliver 37,600 bushels of wheat at a fixed price, and later the amonnt of grain was increased by 10,000 sacks. Be fore delivery was made the price aovanced and Mr. Smith failed to de liver all of the amount sold. By his decree Judge Been held the obliga tion to be binding upon the seller, even though the price had advanced. The outcome of this case has been awaited with Interest by grain men, through the fact that such contro versies frequently arise, but until now there has never been a ruling upon the point. The deer law was also sudly shat tered during the last session of the legislature, and It is difficult to under stand. However, according to the dis trict attorney the open season will be as follows: n the counties of Coos, Curry. Grant, Harney, Malheur, Union, Umatilla and Wallowa, for bucks from August 16 to November 1; for does, from September 1 to November 1. In all other counties of the state the season for bucks lasts from July 15 to November 1, while that for does Is from September 1 to November 1. As Morrow county was not Includ ed with the other deer counties when the law was changed, deer hunting may be taken up in that county on July 15, a month earlier than In this- or Grant counties. COMMISSIONER A COWBOY. Omvaltl West Adopts Novel Method for Getting Information. Dressed as a cowboy and carrying a 'prod pole" on a cattle train through Willamette valley yesterday, Railroad Commissioner Oswald West broke the official record in Oregon for getting information at first hand. Complaints had been made by cat tie shippers against -the Southern Pa clflc railroad and as the complaints were somewhat vague, the commlS' sloner determined to get direct In formation as to the service and so West volunteered to make the trip. He accompanied a shipment of cattle from the upper end of Willamette valley into Portland and was not rec ognlzed by railroad men or officials. He will be prepared to furnish the commission absolute facts as to the service given cattle shipment, on the Southern Pacific FIRST TARGET PRACTICE. Company L Will Hold Shoot on Tutu. A rifle range has been secured on the Peter West place on Tutullla, and the company will march acress the hill in going to and coming from the practice. Accordingly, all mem' bers of the company who can engage In the shoot tomorrow are ordered to report at the armory promptly at 9 o'clock In the morning. Mr. Boylen Is the traveling representative of the Bald win Sheep & Land company or Hay Creek, and Is now engaged with that company as In the past. This morning the little brown Span iel belonging to Charles Cunningham, was run over by Dr. Henderson', auto at the corner of Main and Alta streets and died immediately afterwards. The doctor was running along the street at a slow speed when the dog with sev eral others ran barking towards the machine.
