Sheuerman Case Now On Trial, THE DEFENSE WILL RELY UPON NO CONSIDERATION. Urging the Statutes' Exemption of Gambling Debts From Process bj Law Manning Convicted of Horse stealing, Was Given a Parole Sen tence of Two Years Ryeroft Case Was Deterred on Account of the Absence of Needed Witnesses. At 2 o'clock this afternoon the fa mous case of Matlock versus Sheuer man was called In the circuit court Immediately after the civil suit then on trial had been given to the jury. In explaining the case to the pros pective jurors Attorney D. W. Bail ey (or the defense sold it was action wherein W. F. Matlock sought to re cover 3400 from the defendant for a check upon which payment had been stopped. The defense, he said, would be that the check had been given In payment of a gambling debt .and con sequently was without consideration. When the case was called there were but eight jurors left from the nanel and these were examined while the sheriff sought four others. Tho eight men on hand were subjected to a very prefunctory examination and all "were accepted.' They are Messrs. Hutchinson, Kilgore, Shaw, Richard son, K. L. Smith, Porter, Alloway and Hopper. As the Bpeclal jurors had not yet arrived when the examination was finished, a recess wus taken. Parole Sentence for Manning. Andrew Manning, recently con victed of larceny by bailee for the theft of a horse, was this morning given a severe "mental workout" by Judge H. J. Bean. The jury which tried Manning held htm to be guil ty, but recommended that he be pa roled. In disposing of the case this morning Judge Bean Imposed a sen tence of two years In the , peniten tiary. However, in view of the rec ommendatlons of the jury he said he would temporarily suspend execution of the sentence and allow the de fendant to have one more trial. Three months' respite was granted on con dition that the defendant report per sonally regarding his conduct. Should he follow the straight and narrow path the parole will be fur ther extended. But should he again hegnme Involved in trouble he will be required to serve out the sen tence of two years.
