Dr. W. H. Lytle. state sheep In
spector, is Intending to leave tonight
for Kugene and other places in the
valley upon official business.
A. Kunkel, who has been In east
ern Oregon counties for the past two
weeks, passed through the city yes
terday for his home In Spokane.
President Montie B. Gwlnn of the
Pendleton Savings bank, left last eve
ning for Caldwell and Boise on busi
ness. He expects to remain for sev
eral days.
C. C. Sharp, formerly In the paint
business here, and leader of the
E-iKles' band Inst summer, will leave
tonight for Coos Bay, after which he
will go to Canada for the purpose of
looking over the country.

Matlock Vs. Sheuerman Case
Now On Trial,
THE DEFENSE WILL RELY
UPON NO CONSIDERATION.
Urging the Statutes' Exemption of
Gambling Debts From Process bj
Law Manning Convicted of Horse
stealing, Was Given a Parole Sen
tence of Two Years Ryeroft Case
Was Deterred on Account of the
Absence of Needed Witnesses.
At 2 o'clock this afternoon the fa
mous case of Matlock versus Sheuer
man was called In the circuit court
Immediately after the civil suit then
on trial had been given to the jury.
In explaining the case to the pros
pective jurors Attorney D. W. Bail
ey (or the defense sold it was action
wherein W. F. Matlock sought to re
cover 3400 from the defendant for a
check upon which payment had been
stopped. The defense, he said, would
be that the check had been given In
payment of a gambling debt .and con
sequently was without consideration.
When the case was called there
were but eight jurors left from the
nanel and these were examined while
the sheriff sought four others. Tho
eight men on hand were subjected to
a very prefunctory examination and
all "were accepted.' They are Messrs.
Hutchinson, Kilgore, Shaw, Richard
son, K. L. Smith, Porter, Alloway
and Hopper.
As the Bpeclal jurors had not yet
arrived when the examination was
finished, a recess wus taken.
Parole Sentence for Manning.
Andrew Manning, recently con
victed of larceny by bailee for the
theft of a horse, was this morning
given a severe "mental workout" by
Judge H. J. Bean. The jury which
tried Manning held htm to be guil
ty, but recommended that he be pa
roled. In disposing of the case this
morning Judge Bean Imposed a sen
tence of two years In the , peniten
tiary. However, in view of the rec
ommendatlons of the jury he said he
would temporarily suspend execution
of the sentence and allow the de
fendant to have one more trial. Three
months' respite was granted on con
dition that the defendant report per
sonally regarding his conduct.
Should he follow the straight and
narrow path the parole will be fur
ther extended. But should he again
hegnme Involved in trouble he will
be required to serve out the sen
tence of two years.

Phelps btated that the sheriff was un
able to secure some witnesses needed
In the case against Ryeroft. accused
of llvlnir off the earnings of a pros
titute.. Accordingly the trial of that
case was deferred, and the case of
Matlock versus Sheuerman was set
to follow the conclusion of the cose
then on trial, that of the First Na
tional Bank of Pomeroy. Iowa, ver
sus B. F. McCullough and M. H. Gil
lette.

Judge Brents she would not appear
today and was told by him she must.
When she failed to put In an ap
pearance this morning the court had
a bench warrant and attachment is
sued for her and Sheriff Haviland
was sent to bring her Into court.
He found her In a room In the Del-
nonlco nous.- She told him he
could take her to jail but she would
not testify, that they might persecute
her as they did In olden times, but
she would not testify on the Sabbath;
that Jesus Christ was a higher court
to her than Judge Brents.
When brought before the bar of
the court she seated herself angrily
.mt! maintained a stubborn attitude.
When asked by Judge Brents If she
did not Intend to obey the law she
replied:
"If It don't conflict with the law o(
Cod. That is the higher law."

curred to find out how much rain was
represented by. a given fall of snow
was Alexander Brice of Elrknewton,
who In March, 1705, made a simple ex
periment with the contents of a atone
jug driven face downward Into over

was that a greater or less degree of
cold or of wind when the snow falls
and its "lying a longer or shorter time
on the ground" will occasion a differ
ence In the weight and In the quantity
of water produced, "but if," he added,
"I may trust to the above trials, which
I endeavored - to perform with care,
snow newly fallen, with a moderate
gale of wind, freezing ' cold, will pro
duce a quantity of water equal to one
tenth part of its bulk." So that a fall
of snow of ten Inches represents a

A full grown adder may measure
two feet In length and about six
Inches around the thickest part of Its
body. Its movements are sluggish, and
of course the idea that it is capable of
transferring Its bead from one extrem
ity to the other every six months Is due

terminate In a point, as with ophidians
generally, but is stumpy and resem

cult for an observer situated at a dis
tance of a few yards to distinguish the
one from the other; hence the story of
its being two headed, the fallacy of

had also a right to her opinion and
she did not propose to testify.
She raid she was a member of the
Seventh Day Adventist church, Walla
Wnlla, but it was not because of any
ti-.iclilngs or Instructions of the
church she refused to tcstity. It was
a matter of her own conscience.
