The Prairie City Miner says of the refusal of tha Sumpter Valley rail road to build into Grant county this year: The Sumpter Vulley railroad will not be extended Into Grant county any further this year and the plans for the big sawmill nt Austin have been called off, said Mr. Barton, general passenger agent for the Sumpter Valley road, while here yes terday. Grant county taxes have discouraged Mr. Ecelee, president of the rond, and he has given up alt idea of running his road tnlo the county. Lust July Mr. Barton attended a meeting of the county hoard of equll izatl.in and it was understood that the mllroad should not be assessed any higher in Grant county than It was lu Baker county. When the tax statements were cut, however, the tai In Grant county was double what It was in Pukcr and for this reason Mr. Ecclcs has decided that he has all the railroad In Grant county that he can afford. The tax in Baker county is $14 a mile; In this county It Is $88. In Grant county the Sump ter Valley has built seven miles o,f road and the tax on this portion amounts to one-third of the entire tax. The road Is assessed for (3500 a mile In Grant and $300 a mile for rolling stock; In Paker it Is $2500 a mile with $300 a mile for rolling stock. The tax rate In Baker Is It mills, while in Grant it Is 31 mills. All the rolling stock Is kept In Baker county, yet Grant assesses them for the same amount of rolling stock. Mr. Barton sold that Grant county has a way entirely peculiar to her self in the manner In which tax statements are made. A tax state ment f'ir the gross amount Is sent out ond no one can tell what he Is paying taxes on. The Sumpter Val ley railroad had property assessed to them that they never owned and were n"t assessed for other property they did not own and were assessed on last year. In other cases two or three parties were assessed on the same piece. The plat book which the liw requires has not been touched for two vears and the matter of as sessment Is left largely to chance and good luck. The operation of the Sumpter Val-, ley In Grant county has been ot a loss as during the past winter It has been very expensive to keep the road free fr"m snow so that the train could run. The exrense has been run as high as $200 a day. A board of county commissioners has not the legal right, of Its own volition, to open or close a highway through Indian lands, according to advices received from F. E. Leupp, the Indian affairs commissioner, soys the Lewtston Teller. The advice has been transmitted to the Nez Perce county bourd of commissioners through Agent Jlpps, In the form of a letter addressed to him by Mr. Leupp, which reads In part as follows- "Accordingly, you will close or cause to be closed all highways across Indian lands the title of which is held In trust by the United States for the Indians, which have not been duly authorized by the department, notifying the proper county officials of your action and that any attempt to open or use roads so closed with out obtulnlng permission in the reg ular manner will result In such at tempt being reported to the depart ment with a view to Its presentation to the department of Justice with a recommendation that a suit In tres pass be Instituted against the county officials for the opening of such highways without due authority of law, and that each Individual using sueti unauthorized rond be mode a party to the trespass, und that -the department will not brook any viola tions prescribed under the act of March 3, 1890. by agreement with Indians having the use and occupa tion of the land, or otherwise."
