COMMISSIONERS The Salem Journnl raises the ques tion of the legality of the salaries of the supreme court commissioners, W. T. Sinter and Will R. King, Just appointed by Governor Chnmberlaln. The Journal, In an extended review of the subject, says: If the two newly created and ap pointed commissioners of the su preme court, W. T. Slater of Salem, and Will R. King of Ontario, accept ed their positions with the Idea that they were to receive the -same salary and additional compensation received by the regular Justices of the suprerrie court, aggregating $4500 per annum, each, they will probably be doomed to disappointment when they call up on the secretary of state to receive their warrants. The constitution, article 13, spe cifically provides that each Justice of the supreme ceurt, shall receive an annual salary of 12000 artcT no addi tional fees, emoluments or perquisites and any other sum allowed the new commissioners would ,be In direct vio lation of the fundamental law of the tsale. And It all happens because of the omission of the word "compensation" from the clause of the art whfch pro vides that they shall receive a "salary" equal the "salary" of a Judge of said court, etc In order that they .ntltled to the additional pay received by the Justices of the supreme court this article of the constitution will have to be amended and no provision for this was made by .the legislature and can not come before the people at the next general election, except by Invok ing the Initiative. This act, too, In a technical sense, Is a violation of the constitution, accord ing to the opinions of divers legal au thorities, but It will probably never be attacked because the members of the bar would hardly have the temerity to take the question to the supreme court for decision. Attorney General Crawford, when asked for his views Judging from the wording of the act, gave as his opin ion that the new officials would only be authorised to receive the constitu tionally provided amount, 12000, and, this being the case and both of the appointees enjoying practices which nets them a revenue far In excess of this amount. After a conference with the engi neering department at Portland, the chairman of the Open River associa tion wired Senator Fulton yesterday asking him to secure nn order from the war department for a survey and estimate of the value of the property now owned by the Portland Railway, Light & Tower corporation. It is not understood that the Port land corporation wants to sell any of its holdings at Oregon City, on cither bank of the river, but as the bill in troduced by Senator Fulton contulfn provisions for condemnation, and the engineering department Is anxious to secure ownership of the locks and ca nal by the general government.
