That the priceless timber land of southern Umatilla county Is far more attractive to residents of other states than to those of Oregon and Umatilla county. Is shown by the fact that a constant stream of timber land locat ors, cruisers and speculators Is pour ing from this city into the Uklnh dis trict by way of the Ukiah stage line, dally. Yesterday an extra team was sent to Ukiah and 11 men took passage from this city to that 'place. The average number of passengers Is from four to seven each day, most of this number being strangers In search of land. Very few Umatilla county people are locating timber land In the Uklah district, but locators from Washing ton. Idaho, Montana and other north west states are plentiful. TRAIN FOR SPOKANE TODAY. V. & C. R. Track Will Soon Be Clear ed to Pendleton. Over 2l0 passengers and three full coach loads of mail, baggage and ex press left this city this morning for Spokane, by way of Umatilla. It Is thoucht the train will be able to make the through run without Interruption, as the Washington division of the O. R. &. N. 1 now open and unless an un expected washout occurs traffic will be regular hereafter. Many of the passengers had been In the city for Beveral days awaiting a train for Spokane and two coaches were filled to overflowing and in ad dition a caboose was added to the train. W. & C. R. Still Tied Up. Agent Walter Adams of the W. & C. R., today received notice that work will begin on the Pendleton branch of that line today, at Hunt's Junction. The crews have been engaged in open ing the line between Walla Walla and Dayton and were removed last even ing to Hunt's Jnuction from which point they will work toward this city. The work train on this end of the W. & C. R. has cleared the track as far north as Fulton station and It Is hoped to have the line open In a few days. Thecrewwhlchhasbeenmaroon days. The crew which has been ma rooned here for the past two weeks will lenve In the morning for Hunt's Junction by way of Umatilla over the O. R. & N. They have been engaged In clearing the track and have com pleted ull the work that can be done before bridges arc repaired. The most seriouf damagj to the W. & C. R. line Is though: to be In the Juniper canyon, northwest of Helix. Took Out Helix Mall A. P. Martin, the liveryman of He lix, arrived In the city yesterday after i load of mall and some supplies for Helix. The people of that place have received mall but twice In the laat two weeks since the flood. He says that the roads have been almost Im passable In places betwen here and there. It Is expected that the W. & C. R. will be repaired for travel In a few days. Will Locate in Idaho. Dr. F. A. Lleuallen has sold his in terest in the drug store at Helix to Sam Starr of that place, who will hereafter be a partner of Dr. Grls woid In the store. Dr. Lleuallen it is reported, will leave in a short time for Idaho. FAITH IX NORTHERN IRAnO. I fold by S,. P, Donnelly, Democratic Wnrhorso of Lakevlew. 8. P. Donnelly, of Lakevlew, Idaho, who has beon In town several days until yesterday, Is one of the strong men In the democratic camp of north ern Idaho, . According to his friends, of whom he has some In this city, ho is the lead charger among the party werhorss of his end of the state, and that he has met with some politi cal suacess, though with the minority party, is shown by the fact that he Is a former state senator. However, Mr Donnelly is at present more enthusiastic over the beauties of his home town than over the politi cal situation In Idaho. "We have beaten so many times, while I am not growing weaker in my faith or be coming discouraged, I feel like tak ing the count every time from force of habit." Rut upon the beauties of his home town and county Mr. Donnelly is more optimistic. "Lakevlew Is the pretti est little spot on the globe," declared he, "or at least It Is In the summer time. It lies along side of Lake Pend d'Orellle and is the delight of tourists who have seen the attractions of this and other lands." Over a week ago Mr. Donnelly pass ed through the city on his way to Boise and yesterday he was returning from that place via Portland and the sound over the Northern Pacific. Trull Maker Has Reached Indianapo lis and Will Co Still Farther East With His Ox Team. This afternoon the East Oregonlan received a copy of the book Just Is sued by Ezra Meeker, the Oregon trail maker, who retraced the Oregon trail from Pnyallup, WaBh., to Indi anapolis, Ind., during the post year. He is now In good health and spirits and Is contemplating further trip Into the east with his ox team. A portion of his letter follows: Indianapolis, Ind., Feb. 10, '07. Bert Huffman, Editor East Oregonlan, Pendleton, Oregon. My Dear S(r: I am here'in good order," after a trip of 11 months and seven days, with a result of 20 monu ments on the way. Now, I propose to go farther. There Is a greater work for me and when spring time comes I will drive easterly from here. 'I will simply test the public pulse as I go along on the subject of a na tional highway from the Atlantic to the Pacific ocean. "Yours truly, "EZRA MEEKER." Mr. Meeker's book contains about 250 pages and 24 Illustrations taken from scenes along the route including the dedication ceremonies at Pendle ton. The book sells for 60 cents, post paid, and is a record which will be highly valued by those Interested in the pioneer hlstcry of the country. Mr. Meeker's address is 118 North Senate avnue, Indlinapolis, Ind. CREW RESENTS NOTORIETY. W. & C, R, Men Still Live as Usual Don't Appreciate Slander. Members of the W, & C. R. train crew which operates the transconti nental line between this city and Pas co when conditions permit of such, deeply resent the cheap advertising that Is being given them by the Morn ing Mistake. In this morning's paper there was a short story to the effect that the members of the crew were financially embarrassed by reason of their long stay here and In conse quence were forced to wash their own socks and live upon a self-made menu. "I don't know where they get their Information from," said Conductor Bartholet this morning, "but we are tired of their cheap notoriety. We are still staying at the best hotels and were able to attend the theater last night. Also, we have had money with which to buy some valentines, and would send the Tribune one If we thought It worth while." After many days of testimony and close legal argument, the famous flood damage case of Baker & Fol- som against the city and W. S. By ers was given to the Jury at 12:30 to day. The 12 men were sent to the Jury room for their verdict after they had listened for over an hour to the Instructions of the court. It was after 11 o'clock this fore noon when the lawyers In the case concluded their final arguments and a recess wns then taken until 11:30. In charging the Jury Circuit Judge Bean rend many typewritten pages of Instructions that had been submitted by the attorneys on either side. Also, he read in full the complaint of the plaintiffs, the answer of the defend ants and the other legal documents filed before the case was tried out upon Its merits. Among other things the Jury was charged that the plaintiffs may be awarded damages from both the de fendants, or fronf either of them indi vidually. He charged that if Byers had accepted the culvert at the end of the tall race as a part of his race, he was thereby made responsible for its malntalnance the snme as for other portions of the race. He also charged that If the city had at one time constructed a floodgate at the culvert It was In duty bound to main tain the same. On the other hand, he charged that the plaintiffs could not recover damages If the evidence showed they had failed to use ordi nary care and prudence In trying to protect their goods from damage by the flood. It was 12:30 when the charge to the Jury was completed, and after the bailiff had been sworn the 12 men filed out of the court room to com mence their deliberations. A recess was taken until 2 o'clock. Jury I Slow. Up to 4 o'clock this afternoon the J'fy had not yet arrived at a verdict. Owing to the mass of evidence In the case, the numercus documents sub mitted as material evidence and the length of the Judge's charge, It Is pos sible the Jury will not finish its labors for many hours. Yesterday evening he wns arrested fr being drunk and dlsor derlv. A bottle of nlcohol was found In his pocket. When he appeared In police court this morning he said some boys gave him the alcohol.
