Again that Indomitable Pendleton spirit has exhibited Its vitality and power. Judge John McCall, of the federal court at Memphis, Tenn., has Just de cided that the La Follette amendment to the railroad rate bill, holding rail roads liable for the Injury of employes through negligence of the company or other employes, Is unconstitutional and that an employe cannot recover dam ages under the amendment. This is the first corporation Judge to make himself heard upon the lia bility clause of the La Follette amend ment. About 20 of the leading states of the Union have liability acts, of which the La Follette amendment is a perfect counterpart, and In every state these, acts are operative and effective. To say that it is unconstitutional to hoM corporations liable for negligence In Inteirtate commerce. Is to say in so many words that the corporations own this Judge.
