This discovery wan recently made by District Attorney John H. McNury and brought to the attention of the su preme court yesterday In the hearing of the case of Murphy against Lembke and other and known as the city boundary case. The last legislature adopted n new charter for Salem and extended the clly boundaries to In clude territory not before embraced by the city limits. The plaintiff and appellant contended the act was un constitutional. Among other objections raised, was one that the title of the act failed to comply with section 20 of article four of the state constitution which reads "Every act shall embrace but one subject, and matters properly con nected therewith, which subjects shall be expressed In the title." Now the tlllo of the amended charter "recites that it is an act to amend the former charter, etc., hut does not mention extensions of the boundaries and ap. pellant relied on the last clause of the portion of the section quoted, con tending the extension of the boun daries was one of the matters con nected with th subjects which should hve been Included In the title of the act In conlrpversy. When the word used as subjects Is used in the singu lar Instead of plural It gives a differ ent Interpretation to that section. This discovery It was said Is decisive of , the ense. Error of Long Standing. The remarkable part of It Is that llr. MrXnty finds the error running through overy printed copy of the constitution from the earliest complla lion of the laws of the state to the Intent. When examining the section referred to he was struck with the peculiar change from the singular to the plural use tf the word subject without apparent cause or reason. He was using the latest compilation by Pelllnger and Cotton and he then took up Hill's annotated statutes, and from there he went to the Deady and Lane code, so-called, and still diflKatiB- fied he examined the 'compilation by Matthew P. Deady made in 1S59. the earliest In existence. In each instance the section appeared the same. Then he went to the original docu ment and found the letter "s" omit ted from the word subject where- It Is used the second time In the section mentioned. Schick, editor of the Culdesac Register, was offered $7000 for h's place here, says the Lewlston Tribune. Manager Hackbarth, of the Lapwal Lumber company, made' a bid for this property against Mr. Robblns, but the latter set the figure at $7000.
