The children were drown ed In the south channel of tho river, commonly known bh the "Hlough," on the south side of the government Is land, about two miles below the Da vis ranch house, and four miles down the river from Boise. Mr. Livingston and his family moved Into a summer cabin at the lower end of the government Island shortly after the close of school. At the time of the drowning Mr. Livingston, who Is deputy state game warden, was not at home, being at work near Hnake river. He was reached by long dis tance telephone lust evening and the sud news conveyed to him. He Is now on his way home. There were five children In the Livingston family, the oldest being 8 years of age. There were two older and one younger than the two who were drowned. All but the youngest child were wading In the slough yes terday afternoon. The first Intima tion Mrs. Livingston hnd of the terri ble accident was when she heard the two older children Screaming. She rushed to the door and one of the children cried nut that Morgan and Crawford had fallen Into the river and were drowned. The little tots had waded Into deep water and had been carried away. While there will be a dally mull between Heppner and llardman as before, there will now be only three mall days between Hurdnmn and Monument, and the re sult will be thnt express and passen gers koIiik to the Interior by this route will he delayed unless they make connection on one of the three days each week thnt the stage makes the trip between Hardman and Monu ment. The supreme court today rendered a decision affirming the Judgment of the district court of Blaine county, In the case of John Crowley vs. Croes us Gold & Copper Mining company. The action was brought by Crowley for damages for personal injuries re ceived while at work In the mines of the Croesus company by the hoisting bucket upsetting and emptying Its contents on Crowley, who was at work at the bottom of the shaft, the mech anism of the bucket being defective, the company having notice of such de fect. The Jury returned a erdlct In fuvor of Crowley, fixing his damages In' the sum of 13000, upon which ver dict tho Judgment was entered and la now affirmed by the supreme court. The main error relied upon by the appellant, the mining company, In Its appeal, was the Insufficiency of the original complaint, together with other questions of practice, all of which are held to be regulur and suf ficient to authorize and sustain the Judgment. The opinion In the case Is by Chle Justice Stockslager, concurred In by both justices. Boise Capital News. Forty-One Filings Made. From 9 o'clock yesterday morning, when the land office opened, until after 6 o'clock last night, the office force worked to Its fullest capacity, recording the 41 filings that had been made for land In township 4 2, range 4 west. With but two exceptions all of the applications were for home steads, these two being for ' timber und stone claims, both of which were suspended pending the selection by the state. The earliest settler on the land was J. Wynne of Freese, who waited 17 years to make his filing. The newest settlors were somo who established their residences a few months ago. There were a number of women mak ing filings. Lcwlston Tribune. New Bridge Over Powder Hirer. Superintendent of Construction O. B. Moulton. who has been engaged In the building of the road across Pow der river, at the north line of the Bowen farm, south of Baker City, where the roRd leading to Malheur City crosses that stream, reported at the Democrat office last evening that the structure Is completed and ready fur travel. The bridge was washed out during the spring high water and a failure to get timbers caused a long delay In replacing It. The bridge has been constructed on the Howe system, and Is the best bridge of its size In the county. Ba Ver City Democrat. Xiiiiiunnkcr Iaiivcs Morrow. J. R. Nunamaker has recently sold about all his real estate and live stock holdings In Morrow county, and has bought a 35-ncre tract at Hood River, paying therefor $15,000. He sold what Is known as his lower place on Hhea creek to Archie Cox. the consideration being $17,000. The upper place, consisting of 3000 acres he sold to William Swlck of Cirant county, the consideration being $10 an acre, or $30,000. Mr. Swlck also bought his sheep at $5 per head. Mr. Nunamaker expects to movd to Hood River to reside permanently and highly Improve his acre tract that he recently bought there. Heppner Times. SliluHd 7l!U0 Sheep. John Fleming, tho well known and popular stockman, buyer for the Chl caog stockyards, arrived . In Baker City yesterday and completed another deal for Ray Brothers, and will this morning ship 7200 head of sheep to Montana for feeding on the ranges of that state. This makes about 60,000 head of sheep already handled from Oregon this season for Ray Brothers, a large portion of the animals having been selected In Baker county. Ba ker City Democrat.
