The papers In the case were filed
this morning by Peter West, attorney
for the plaintiff. Thn complaint re
ilies that the two were married here

From the time of
the'r marriage until the commence
ment of the suit the plaintiff declares
her husband has been cruel and In
human towards herself ind son. She
says ho frequently drove the son away
from home, calling him and the de
fendant also by vile and Insulting
names,
Also the plaintiff alleges her hus
band was frequently away from home
for lona- periods at a time and failed
to provide her with the necessities of
life. Consequently the plaintiff was
forced to work for living.
Made $7000 at "Speculating."
Mrs. Estes states In the complaint
that her husband followed the occu
pation of a "speculator, easy life," at
which calling he made 17000 since
they married. However, the wife de
clares the defendant hoarded all of
this amount to himself and has even
failed to properly support her during
that time.
It Is claimed in the complaint thot
aside from the money which the de
fendant has "hoarded" he also owns
n house and three lota In this cnty,
but that the furniture In the house
is the individual property of the plain
tiff. She asks that the court award
her title to the three lots, that the
deefndnnt be required to account for
the $7000 and to pay 160 attorney's
fee In the divorce case.
As the plaintiff says she Is afraid
of the defendant the court was asked
to Issue an order restraining him
from in any manner molesting tlu
plaintiff, or disposing of any of his
properly while the suit Is pendlns.

business men to place seats on the
sidewalk In various places for th
Fourth only.
A warrant for $75 was ordered
drawn In favor of City Attorney John
McCourt.
Gunrdliig City Property.
After the council had adjourned
last night It was again convened for
he purpose of discussing the strip of
land at the north end of the Muln
street bridge. It was alleged that
the strip was being gobbled up Into
the tract being Improved by W. F.
Matlock, and the cily attorney was
ordered to take necessary steps to
protect the city's property.
Work on O. R. A N. Track.
A large force of trackmen and
bridge carpenters are- now at work
making permanent repairs to the
track three miles east of Bingham
springs, where there was a washout
1000 feet In length. This Is exactly
at the point where Engineer Patty
and Fireman Mllllgan were Instantly
killed by their engine plunging Into
a washout In January, 1903. The
track will be built In a substantial
manner and the creek channel will
perhaps be changed at that point to
avoid future danger from high water.

Major Edwards Investigates.
This afternoon Mujor Ed
wards, agent on the reservation,
has been In the city for the pur
pose of looking Into the death
of Joe Bennett. It has been
found that the dead man had
two flasks of whiskey In his cell
when found and It Is believed
the same was smuggled to him
by his wife when she visited
him during the afternoon. How
ever, it Is not likely the whis
key was doped, as other Indi
ans in the jail also drank of It
without becoming sick. How
ever, Major Edwards will have
the whiskey remaining in the
bottles analyzed to see if any
thing Injurious is contained
therein.
John Deathman Implicated.
After considerable investigation this
afternoon, .Major Edwards nnd Dis
trict Attorney Phelps learned that the
liquor which had been given to Ben
nett In the afternoon yesterday hod
been sold to Flank N'orrest, a three
quarter Indian, by John Heathman,
bartender for the Oregon Wine &
Liquor company. It Is said that Nor
rest secured the liquor from Heath
man and then gave the same to Ben
nett's wife, who passed It to the lat
ter through the bars of the Jail door.
It Is probable that Heathman and
Nor-est will both be Indicted by the
district attorney.
Bennett Was Found Dead.
Joe Bennett, the Umatilla Indian,
passed to his "happy hunting ground"
from the county Jail sometime be
tween 5 end 6 o'clock lost evening.
He was found dead In his bunk short
ly before o'clock when Deputy
Funk made the rounds of the Jail to
place the prisoners In the cells for the
night. The deputy's attention was
called to Bennett by other Indians In
the Jail, who had noticed him lying
very still for some time.
According to the other prisoners,
Bennett started to go to his cell late
In the afternoon, saying he was tired.
As he was going through the cell door
he fell and struck the back of his
head on the Iron door. However, he
arose and went Into the cell, so his
fellow prisoners were not alarmed
over his Injury.
In the opinion of Coroner Hender
son, who was called Immediately. Ben
nett's death was caused by concussion
of the brain resulting from his fall.
As there was nothing suspicious con
nected with the case the coroner did
not consider It necessary to hold an
Inquest. The dead man's body was
removed to the Rader undertaking
parlors and will be burled In the cem
etery on the reservation.
Joe Bennett was well known among
those who are familiar with the Indi
ans of the reservation. He was a man
of medium age and rather Jovial dis
position. He was a frequent visitor
in the local police court and was serv
ing a term In the county Jail for tak
ing liquor on the reservation.
Like many others of his tribe, Joe
insisted on wearing long hair and
moccasins. When asked one time
why he did this he said that an Indian
who did so would go to the Indian
heaven when he died, but that If he
wore short hnlr and shoes he would

During the afternoon yesterday.
Bennett's wife nnd mother called on
him at the jail and had a long visit
with him through the bars of the Jail
door. However, as they were all In
a good humor, the officers do not
think the Indian's death was the re
sult of the visit.
