A ;: Allotted Indians Who Have Adopted tike White Man's Ways Have the Rights of Cldxciwliip Half-Hloodfi May lie Considered Indiana, While the Quarter-Bloods Are Considered Whiten Ussrc Vary In Different States. ' . Attorney General Crawford, in an wer to Inquiries from M. F. Parker of the Klnmath Indian agency, wrote the following official opinion yester day, says the Salem Statesman: Replying to your of the 4th lnt., relative to the status of the so-called. Indians, viz.: Half, quarter, etc. blood, at the polls, permit me to say that the question really Is whether they are considered Indiana, then they have the right to vote If they have Avnrari thnlr tr!htl relations and have adopttd the habits of clvlllantioi!. or If they received allotments of land under the United States allotment laws relative to Indians. My opinion to J. W. Evans, assis tant sunerlntendent of the Klamath Indian reservation, under date of Varch 4. 1906. answers the question and holds. In substance, that all In diana who have received land by al lotment are citizens of the United States, and entitled to the right to vote, together with all other rights, privileges, and Immunities of such citizens, etc., and I cite authorities In iiM oninlon which cover the point. A n the status of one-fourth- bloods and half-bloods. I am of the nninirtn that one- fourth-blood would be considered a white person, and a n,1 entitled to vote, wnus - k.if.Kinorf if his mother waa an Indian woman and his father a white man, would be considered an inaian, ... hiM taklnar the status of. Its I have not the time to thoroughly Ammine this matter, but In the case TTnit.i state vs. Sanders (U. 8.) 27 Federal Cases 60, 861, It Is held a child partakes of the conditions of the mother, and If the mother Is an i.ji.. h rhilii will be so considered within the provisions of the act of 1834. lection 26, declaring that the laws of the United States for the pun ishment of crime In the Indian Terri tory shall not exjend to the crimes committed by one Indian against the person or property of another. The child of white woman by an Indian father shall, for the purpose of thtit act, be deemed of the white race, the conditions of the mother and not the quantum of Indian blood In the veins determining the condition of the offspring, this standard follow ing the common law rule, which was borrowed from the civil law. In the case of In re Camllle (U. S.) Fed eral 26; the court holds that "A per son of half white and half Indian blood Is not a while person within the meaning of this phrase as used In the naturalization laws, but an Indian." In the Virginia code, section 49. It is provided that "Every person, not a ' colored person, having one-fourth or more of Indian blood shall be deem ed an Indian." However, our statutes contain no provisions upon the ques tion, and therefore I am of the opin ion thnt the courts would hold that any person who has less than one half Indian blood would be consider ed a white person. n.. ..-. of Indiana has held that all persons recognized ns Indians by the Indians themselves, ana wnu j ii-h hv birth, education and lnnguage. and has three-eighths Indian blood, are Indians.
