In the legal battle waged between
the state of Oregon and the Portland
Oerfernl Klectrlc company, the first
encounter was won by the company,
says the Oregon Pally Journal. The
state is suing for 10 per cent of the
net ci.rnhigs of the locks at Oregon
Cltv, now owned by the company,
from 1S74 to 1904, claiming this
money is due on account of a con
tract made with the company that
built the locks at the time when the
state auin-oprlated $200,000 to aid In
this wom.
Frederick V. Holtnan, attorney for
the company, filed a demurrer to a
part of the complaint, alleging that
owing to the statute of limitations no
motleys could be sued for that were
alleged to have been collected before
1S97. Presiding Judge Arthur I..
Frazer this morning sustained the de
murrer. In arguing the demurrer, attorneys
for the state contended the statute
of limitations did not run against the
commoawcalth. that the giving of the
subsidy to the company gave the state
an interest In the water improvement,
that this interest in the locks could
also be claimed In that they were
built on a portion of the state's prop
erty and. tfiat the company was acting
as an igent for the state.
Judf. ? Prayer held that under a law
passed in 1103 the statute of limita
tions could not run against the state
heieafter nor six years prior to the
passing of the hill. This decision
wipes out a large portion of the de
mand made by the state.
The action was begun several weeks
ago by Attorney Cleneral A. M. Craw
ford and District Attorney John Man
ninir. The locks at Oregon City were built
by the Willamette Falls Canal
Loci's company, whose interests have
since beei absorbed by the Portland
Otenernl Plectric company The for

Tills was at last granted upon
the condition that the state was to re
fer, e 111 per cent of the net earnings

elaborate plans have been made to
entertain the Journal's guests.
Team Went Into tliii Canyon.
West brothers, living at the Lower
Uridine, had a serious runaway some
time iiko. They owned a fine span of
Kiays, welching in tho neighborhood
of 1 440 pounds each. One day while
cuing after a loud of hay and passing
through a gate the team was stopped.
While Mr. West was shutting the mite
they took a notion to try their speed,
but forgot about all danger, running
to the brlnk-of Deep canyon where the
rim was about 40 feet high, they
mude a short turn, the hind wheels
of the wagon slid around and off the
bluff taking the team with it. Ono
horse was killed outright, the other
llvlUK two weeks. The wagon was a
total wreck and Mr. West said that
tin two pieces of it were together.

many us any other paper. The train
leaves Pendleton for Helix at 5 p. in
putting t.he Pally East Oregonian In
Helix at 6 o'clock, or two hours after
it is issued. Wlien the morning pa
pers arrive there their news Is an
cient history, hence the insignificant
uumbcr of person who take the
morning paper. The same is true of
Adams, Athena, Weston, Milton and
Frecwater. The same Is true here In
Pendleton, as the paper In the morn
ing must of necessity repent what has
already teen told the evening before
