DOWNEY PLEADED NOT GUILTY
' Arrangements are now being made
by Physical Director Wilson of the
Commercial association gymnasium
for the organization of ladies' classes
for physical training and atsu for a
basket ball tournament by the young
men of the association.
Tomorrow afternoon at 3:30 will be
the first meeting of the young ladies'
student class and work will be given
at that time for those who come pre
pared for It Only a limited number
can be accommodated In the class, and
It is Intended to have meetings twice
each week, one on Wednesday after
noons and the other Saturday morn
ings, commencing at 9 o'clock. Also,
It is proposed to have a ladles' class
for those of the city who care to take
, the work and the same will meet dur
ing the forenoons. However, no de
tailed plana for this have yet been
made.
Tomorrow evening all men In the
gymnasium who are interested In bas
ket ball are requested to meet for the
organization of four teams for the
tournament.
Four captains will be designated at
the start and these men will each
ehose their teams from those present,
each captain choslng a man alternate
ly. Each team will thereafter be un
der the charge of Its captain and will
be trained by him for contests with
the others.
The four captains and Physical Di
rector Wilson will constitute a board
which will make rules for the tourna
ment and decide upon how long It
shall continue.
Two regular basketball games will
then be played each week so that each
of the four teams will participate In
one game weekly. At the end of the
contest the names of the winning
team will be placed upon a hardwood
slab and placed In the trophy room of
the association.
With the opening of the basketball
tournament it Is expected that more
Interest than ever will be aroused In
the gymnasium work for the tourna
ment will surely be hotly contested.
With the gymnasium now In reali
ty but two weeks old. the work has
ieen gotten into such shape by Direc

Say Uo Was Rroucht Into the Trou
bio With Matlock.
Dan Downey appeared before Re
corder FIU Gerald and entered a
plea of not guilty to the charge of as
sault and battery made against him
yesterday by Newton Lee, who al
leged that Downey and Guy Matlock
had set upon him Saturday night in
the John Schmidt saloon.
According to Downey he has been
wrongfully brought into the case by
Lee as he says that he had no part In
beating him up and that he took Mat
lock off and assisted Lee in getting
cleaned up after the trouble. Also, It
I Is evident that Downey was not trying
to evade the police ns he was in the
city all day Sunday and on the streets.
Yesterday morning he says that he
went In to the country buying hides
and did not return until evening.
When he did so he sought Judge Fltx
Gerald and told him the story of the
Saturday night affair and said he
wanted to clear himself of the charge
against him.
As Lee has gojie to Cold Springs to
work it will be impossible to have
him here as a witness for an immedi
ate trial and as a result the same has
been set for Saturday, when he will
be put on the stand should he appear.
According to Downey he had fallen
Into company with Matlock. that eve
ning, but had not been with him be
fore for more, than five minutes In
six months.
Another fine herd of Umatilla cattle
will be scattered over the northwest,
to enrich and Improve the herds In
other sections of the country. Just as
the Wade herd was distributed abroad
from this county something over a
year ago.
W. S. Goodman of Hudson Bay,
near Freewater, will sell his fine herd
of full blood Shorthorns, at public
auction, on Novojnber 15, at the Hud
son Bay stock farm.
The herd consists of 100 head of
pure blood Shorthorns, aged from
months to 9 years, all having direct
and authentic pedigrees, and all hav
lng been bred with the utmost care.
It Is one of the finest collections ot
cattle In the Inland empire and Mr.
Goodman's sale will bring many en
thuslastic stockmen from all over the
northwest.
The sale will begin at 10 o'clock
on November 15, with Col. J. L Bald
win as auctioneer.
KLAMATH IS PROSPEROUS.
City May Re Equipped With Auto,

This morning C. I Young, who is
here In the interest of the automatic
telephone company, received a mes
sage from F. H. Stow saying that
the city council of Olympla, Wash.,
hud last evening voted the company
a franchise to establish their system
In that place.
Since his arrival here Mr. Young
has been meeting the different mem
bers of the council and will go before
that body tomorrow evening asking
that a franchise be given his com
pany. An ordinance tor that purpose
has already been drawn up and filed
with the city recorder.
Teachers' Contract Filed.
The following teachers contracts
have just been filed with County
Superintendent Frank K. Welles: I.
H. Gobbell, district No. 105, four
months; E. E. Larson, district 21.
three months; James A. Wassen, dis
trict 76. three months; Fannie J.
Scott, district 3, four months, and
Hattie Hastings, district 92, three
months. The salaries from all of the
above are $50 per month, excepting
one. which Is $45.
'TWAS IDAHO'S GAME.
Moscow Football Team Won Yester
day's Game By a Score of 8 to 0,
The University of Idaho football
team won the game from the Wash
ington agricultural college team of
Pullman, by a score of 8 to 0, at the
Moscow gridiron yesterday afternoon.
Both teams were In the best of con
dition and the game was closely contested.
Weed Hallway Certain to He ISuilt
Into Hint District.
Everything is very prosperous in
the Klamath country, says C. A.
Moore, who has just returned from an
extended trip through that district,
says the Baker City Herald. Stock Is
In good condition and good prices
have been prevailing, the prices rang
ing from $25 to $27 per head. All
the cattle from this district are sold
to the California market.
Mr. Moore says that the Weed rail
road will certainly reach Klamath
Falls next slimmer. At present the
nearest railroad point is about SO
miles distant, but the wagon road, he
says is lined with freight teams nt ull
hours of the day.
The government irrigation project
Is well under way and will no doubt
be completed. "A man who Is well
acquainted with the situation and
'facts," says Mr. Moore, "told me that
there would be 270. 0MO acres of land
coming under this ditch, making a
tract about 12 miles wide by 35 miles
long. All under water."

Funeral of J, O. Lamh.
At 9 o'clock this morning the body
of the late J. (). Lamh. the Cayuse
section foremun who was killed by a
freight train some time 110. was bur
led in Olney cemetery. The service
was held from the Catholic church
and was attended by a fe,v friends of
the dead man and his two brothers
who came here from Nebraska lo take
charge of the remains.
To St. Anthony's Hospital.
Mrs. William Moss, a pioneer wo
man of Island City, was brought over
yesterday evening to enter St. An
tony's hospital, where a serious op
eration will be performed tomorrow
by Dr .A. L. Richardson, of La
Grande, and Dr. Cole, of this city.
She is accompanied by her husband,
William Moss, and her son, James
Moss, both prominent citizens of
Union county. Mrs. Moss is 72 years
of age and has been In a critical con
ditlon for several years.
Weston's Baby Crop.
The following births have been re
corded in the vicinity of Weston dur
ing the past few days: To Mr. and
Mrs. T. J. Michael, a son; to Mr. and
Mrs. Burn Banister, a daughter, and
to Mr. and Mrs. Isaac Hagen, a daughter.
PRACTICE FOR RIG GAME.
Football Team W ill Play Walla Walla
High Siiool Saturday.
This afternoon regular practice was
csumed by the high school football
eleven, none having been held yester
day, so as to allow the players to fully
recover from the effects of Saturday's
raine. However, the team will now
be put through a hard course of work
by Coach Dan Smythe. and the de
fects which became apparent during
the recent game will he remedied.
Among other things greuter quick
ness will be developed In the back
field. James Thompson, who played
with the team during the first of the
season is again in school and will be a
candidate for half back, though he
will have two strong men In Strand
and Pierce to contest with for that
position.
All energies are now turned to the
game Saturday with Walla Walla
high school. In which It Is thought a
bigger score will be rolled up than
was done In Saturday's game.

meeting was for the purpose of con

John Corcoran, a pioneer of Wes

While taking Joe Thompson, an In
sane man, to Simons Junction on a
handcur to catch the Spokane flyer.
Deputy Sheriff Byrnes and some sec
tion men had a narrow escape from
death, says the Walla Walla Union.
The men were sending the car along
at a good rate of speed, when about
200 yards from the siding the train
rounded a curve. All Jumped but
Thompson, who bad to be dragged
from the car. While the men wore
taking the car off the track Thomp
son tried to throw himself In front
of the train but this was prevented
The handcar was taken off the track
Just in time to let the train go by.
Thompson was brought to Walla
Walla yesterday morning and put In

railroad and while in the discharge
of his duties suddenly became violent
