San Francisco, Oct. 6. The allen-In-ttranxit
head tax case was decided
ywiterday by the ITnlted Slates circuit
court of appeals against the Oceanic
Steamship company and in favor of
the action of United States Customs
Collector Frederick H. Straiten In hav
ing collected 32 per head for 21 alien
passengers In transit through the
United States.
The opinion of the court was writ
ten by Judge Hawley, and a vigorous
dissenting opinion was filed by Pre
siding Judge Gilbert. On the trial in
the ITnlted Slates circuit court Judge
Morrow decided that the Imposition
of 32 head tax, even temporarily, upon
alien passengers In transit was a viola
tion of the statute, which expressly
forbids the Imposition of such a tax.
The government Appealed.
Judge Hawl"y held that rule 15 of
the regulations of the commissioner
of immigration was valid: (hat II was
necessary to protect the government
from Imposition by aliens who might,
at an Asiatic or Australian port, pur
chase a through ticket to Europe,
then on their arrival at Sun Francisco
or other point In the United States
might er-Tl the ticket and remain here,
thus defrauding the government out
of SJ.
Judge Hawley called attention to
the fnct that the record did not show-
that any of the 210 passengers had
ever left the United Stales.
SURVEY NORTH COAST ROAD.
All Preliminaries Are Now Slaile and
trailing Will Soon Begin.
North Yakima, Oct. 5. A party of
engineers under the charge of H. F,
Murble, of this city, will leave here
this afternoon or tomorrow for the
Karnes valley to lay out the route of
the North Coast railway.
The line has been surveyed from the
mouth of the Tletan to the Cowllu
Mr. 'Marble will complete the line from
Tletan to this place and probably on
pass and all the details completed
to Sunnyside.
He pent Tuesday In gutting togeth
er a party of men to assist in doing
the work, which he expects to com
plete In about three weeks. The North
Coast railway Is now busy getting the
rights of way for the road up the
Naches. Some purchases have already
been mado for this purpose. The com
pany expects to get things In shape for
grading to be commenced before win
ter sets in. The construction of the
road will be pushed as rapidly as pos
slide.
When it Is to be completed may be
gathered from the application for a
franchise for the road to pass through
tills city. This franchise says that 100
miles of the road Is to be completed
In IS months and the road Is to be
finished and ready for business in tws
years.

posed resignation.
Sargent nnd John Mitchell were
close personal friends during all of

Governor Mickey was advised and
promptly wired the sheriff to take ac
tion to protect Hamilton and his
neighbors from further molestation,

Meanwhile Adjutant General Culver,
of the Nebraska National Guard, will
have the militia ready to go to
Hooker county.

The Osage Indian country, of which
there is 1.4 71.000 acres. Is rapidly be
ing settled by white farmers from
Missouri and Kansas, who occupy the
lands under leases, says a Guthrie,
Oklahoma, dispatch.
Thus far 1S50 Indians have selected
their allotments of land, or about 75
per cent of the tribe. At the present
time there are over 1250 leases on
tile In the agent's office awaiting his
approval, the majority of them being;

lected as allotments. i
The leuses are of two kinds, Im- j
proved and unimproved. The former

farms and the prices average 32.60 per
acre for five years. The unimproved

a house and barn, dig a well, put up a
three-wire fence around the lease and
