Washington, Dec 12. The govern ment ha been advised that after re peated delays the caaea of Benjamin D. Greene and John T. Gaynor, who were implicated with Oberlln M. Carter In the notorious Savannah river contract scandals, and who fled to Canada to set beyond American jurisdiction, will be taken up by the privy council of England today. This tribunal corresponds In dignity and Importance to the supreme court of the United States, and it is hoped by the Washington authorities to obtain from It a decision which will place the exiles tinder American Jurisdiction. Proceedings for the extradition of Greene and Gaynor war begun as soon as the American authorities r. celved information that they had taken up their residence In Montreal. Accordingly an application was made and a writ was Issued by an extradi tion commissioner of Montreal. The fugitives, however, were apprehended In Quebec, to which jurisdiction they bad made a sensational escape. They were taken to Montreal, and a Quebec judge Immediately Issued a writ of habeas corpus, which was served on the Montreal Jailer. He brought his prisoners, Greene and Gaynor, back to Quebec, Where a curious legal squab ble ensued, which finally resulted in the Issuing of another writ of habeas corpus by Judge Caron. It la from this latter writ, which permits the freedom of Greene and Gaynor within the boundaries of , Quebec and exempts them from Inter ference from American authorities, that the United States government ap pealed to the privy council of Eng land. Officials of this government now believe that every legal obstacle has been removed and that a final de cision will be reached soon. Several eases Involving large prop erty Interests are awaiting further ac tion because of the necessity of the presence in the United States of Greene and Gaynor. who are defend ants, Should the decision of the privy council be favorable to the conten tion of the United States. It Is believed that little time will elapse before Greene and Gaynor. through extradi tion proceedings, are again safely un der American Jurisdiction.
