Farmer Is the 19th person to die this year In the United States from football accident, Well Known Umatilla Coonty Farmer IaHed Away Suddenly in Illinois. John Schmidt yesterday evening re- . celved a message announcing "the sud- den death of Peter F. Eggers, Mrs. Schmidt's father, at Sibley. III. Mr. Eggers left here two months ago for Illinois, for several months visit and Mr. Schmidt received a letter from him 1 days ago. In which he -stated that he was enjoying his visit and ex pected to remain for several months yet. His son, Peter Eggers, accom panied him, and will bring the -re mains home, expecting to arrive here next Monday. Mr. Eggers was a well known far mer of the Cold Springs district, cem- ! lug from Germany to Umatilla county j 15 years ago. He was Industrious and ! frugal and has become well to do tn 1 the few years residence In this coun i ty. His wife died at the Cold Springs , home on May 1. Just eight months te j a day. before her husband's sudden death yesterday. Six children sur vive him. as follows: Mrs. John Schmidt of this city, Mrs. Andrew LeininKer, three miles north of Helix; Tit. Rudolph, of Sibley, III., whom Mr. Eggers was visiting at the time of his death; Peter, William and John Eggers, all of Umatilla county. The remains will be taken to the Schmidt residence In this city on ar rival, but no funeral arrangements win be made until the body arrives. Mr. Eggers was 2 years of age, and came direct from Germany to Uma tilla ounty, 15 years ago. COURT AT HEPPNER. Home Smiling Case Will Be Appealed Oemvell Held for Trial. Ben K. Davis, who has been acting as court reporter during the session of the state circuit court Just adjourn ed at Heppner, returned home . lost evening, accompanied by Mrs. Davis. The term of court at Heppner was an interesting one. "The horse stealing case In which A. H. Rae and Charles Matteson were convicted of larceny of two horses belonging to W. E. Royse," said Mr. Davis, "was strongly fought and will be appealed to the supreme court. Nearly 60 witnesses were examined by the prosecution and the defense, but the state won, and the defendants were sentenced to three years each In the penitentiary. District Attor ney G. W. Phelps and Judges James A. Fee conducted the prosecution. Judge S. A. Bennett of The Dalles, represented the accused. "The case growing out of the kill ing of Frank Natter will- be tried at the next term of court. Dee Matl6ck was acquitted at the preliminary ex amination, and C. E. Creswell Is held on a charge of assault with a- deadly weapon. Circuit Judge W. R. Ellis will re turn home from Heppner thlB after noon, i IMPROVES WITH AGE. Tfcrw Play at the Trnser Is Comedy Pure and -Simple. Pathos mingled with comedy, a quaint old story of love and the good ness and boseness of man, is told In "Shore Acres." The play Itself Is old but like good liquor, It appears to Im prove with age. and at each retelling It sounds prettier than ever. A large audience witnessed "Shore Acres" at the Fraxer lost night. The next attraction will be "Who's Brown?" which comes "Monday. This play is a comedy, pure and simple, built to cause merriment. Helix Is Prosperous. J. S. Norvel, who recently purchas ed the mercantile business of Sones Walker at Helix, returned from Portland this morning, where he has been on business for a few days. He has ordered a complete stock of fur niture for his business at Helix, and wir add other features to his business In the near future. Mr. Norvell Is well pleased with Helix and believes that It has a promising future. Suit on Prnmissory Note. George W. Proebstel of Weston, has hrouEht action in the state cir cuit court against John O. Moore- house and R. M. Powers, as adminis trator of the estate of Thomas Moore house, deceased, to collect the sum of 3416.76, alleged to be due on certain promissory notes. Margaret Forsythe has brought suit in the state circuit court for a divorce from Douglas Forsythe on the grounds of grosB drunkenness and failure to provide. Calhoun, one of the most successful field evangelists In the Presbyterian church, now conducting a series of meetings In Tacoma, will be in Pendleton on next Thursday and Friday nights, to arrange for an evan gelistic meeting, to be held in .his city later. Mr. Calhoun will preach two nights while here. He has re cently held successful meetings In Portland, and Is constantly engaged in missionary work. Five Plain Drunks. Five persons appeared in the pris oners' dock at police court this morning. Drunkenness wus the charge preferred against each one, and they all pleaded guilty and were sentenced to three days In Jail. They are H. Keefer, Oscur Kuig. John Wilson.
