Washington. D. C, Oct. 25. The
case of Warren B. Wllnon of Hins
dale, 111., against Secretary of the
Treusury Shaw, which was called for
hearing today in the supreme court
of the District of Columbia, has at
tracted keen attention from the fact
that it involves the constitutionality
of the Spooner act for the construc
tion or the Panama canal, and, in
fact, the entire proceedings of the
United States In the purchase of the
canal and the work upon Its construc
tion.
The suit Is for the purpose of pre
venting Secretary Shaw from paying
out any money for the construction of
the canal or of issuing bonds for
money to continue the construction.
It Is asserted In the petition that
the Spooner act is unconstitutional
and invalid, both in Panama and the
t'nlted States; that even If it were a
valid and legal enactment, Its terms
and conditions have not been com
piled with and do not purport to au
tliovze the payments that are now
tieinc made; that the payments being
made are unauthorized and unwar
rained, violating the provisions of the
constitution, which state that no
money shall be drawn from the treas-
u-y except upon appropriation made
by law.
