The creation of a national non-partisan commission on the Lewis and Clark Exposition Is one of the provisions of tho bill now penJ- ng before umgross. If the bill shall pass, tl.r commissioners, seven in number, will be appointed by Presi dent Roosevelt. The act has been filed by tho governor nnd has become a law. Tho new law Is Intended ns a com pletion ot Section 5030 of Uelllnger & Cotton's Code, which section was enacted In 1869. Through some er ror a portion of that section was ad mitted before tho act of 1899 passed and tho section was dofectlvc. The words that arc supposed to havo been omitted have been supplied and ns now amended tho section reads as follows; "Section 6030. Such porsons, com panies and corporations may also maintain an action for tho condemna tion and appropriation of the right to tho flow of water In any stream Horn which It or they propose to ill vert water, below the point of diver sion vested ln the owners of lands lying contiguous to such stream bv virtue of their location. Such action shall be brought In tho county whero tho lands to be affected, or bomo por tion thereof, are situated and the manner of proceduro therein shall be similar to uiat prescribed In tne con demnation of lands In Chapter 2, of title 41. "Provided, that no person ownlnc lands lying contiguous to any natural htream shall, without his consent, bo deprhed of water tor household or domestic use, or for t)io purpose of watering his stock, or of water neces sary to irrigate crops growing upon Mich lands, and actually used there for, nor shall tho rights of any prior approprlator without his consent be materially affected or Impaired re gardless of whether such appropria tion was made for tbo use upon ri parian or non-riparian land." It will be noticed that under tho piovlslon of this act no owner of o water right can be deprived of water, for which he has use. The purpose, evidently. Is to prevent a riparian1 owner from exorcising his supposed rignt to have water flow In Its chan nei, even uougn no lias no use lor it. Good for Children.
