The supreme court affirmed the de
cision of the lower court, holding
that the road was a public highway.
Having become under such statutory
proceedings, dedication and accept
ance anil prescription and user, and
as the road bad been In use 13 years,
this was sulllclent to amount to an ac
ceptance of a grant made by con
gress nnd for the establishment of a
highway over the stale land, either
by dedication or prescription.
