There are probably a half dozen veterans of the Indian war of 1855-56 In Walla "Walla county who will bene fit by tho act passed by tho Oregon legislature to compensate them for services, says the Walla Walla Union. In all there are probably S00 who come within tho provisions of the t act. j Attorney W, F. Crowe lias received t a copy of the act from Adjutant-Gen eral C. U. Gantenbein of Oregon, to gether with a blank claim and in structions to claimants. The act appropriates ? 100,000 from tho general fund of tho state of Ore gon, nnd provides that each non-commissioned officer nnd private who served Oregon Territory In tho In dian wars of 1855-5C shall bo entitled tc receive for such servicos tho sum of $2 per day for himself, and all commissioned officers shnll receive such sum as was paid to officers of the same rank of the army of tho United States at that time; provided, that any amount paid on account thereof by the United States shall bo deduct ed. In regard to the construction, "Shall be entitled to receive for such serv ices the sum of $2 per day for him self," the attorney-general of Oregon has held that neither the widow nor the heirs of a deceased volunteer is entitled to compensation for services rendered by him, so that only surviv ing volunteers are entitled to the compensation provided for the In tho act. Attorney Crowe, however, is of the opinion that under the spirit of the act the widows and heirs of de ceased volunteers are entitled to re ceive compensation. The net further provides that the claim for such services, verified by the claimant, shall be presented to the adjutant general, who shall ex amine and pass upon the same, and may require additional and corrobora tive evidence. The secretary of state will then issue warrants for the amount found to be due claimants. So far as It relates to volunteers the act is to be so constructed as to apply to all who were in the service of the territory of Oregon during the Indian wars of 1855-5C, and Is extend ed to the Ninth regiment of the Ore gon militia while it was In actual service during the war. The territory of Oregon, by act of the legislature pased on January 24 185G, promised to pay the veterans serving in the Indian wars the same compensation as provided for in the recent enactment. However, neither the territory nor the state of Oregon has paid the volunteers for their serv Ices. Many of them have died with out being compensated for their losses in the war. Yesterday evening the executors of the will of the late Joseph I... Stubble field, who are also trustees under the will of the home for orphans and in digent widows to be established in Walla Walla, made settlement with Casaan Stubbiefield, widow of the de ceased whereby legal proceedings in stituted by her for the setting aside of the will were stopped, says the walla walla Union. Under the pro visions of the will Mrs., Stubbiefield was to receive ?C0OO, and this, so far as was given out, Is what she will re celve in the final settlement. The trustees, R. M. Dorothy, E. A, Reser and C. M. Rader. had been working on the basis of settlement agreed to for three days, and it was on the advice of Barton A. McGuIre, of laano, urotner of Mrs. Stubbiefield, and George McGuIre, ex-county audit or of this county, her nephew, that sue withdrew opposition to the carry ing out of tho provisions of the will. C. M. Rader, one of the trustees, said last night that Mrs. Stubbiefield is the only heir at law, and the only person who has the right to question tlie validity of tho terms of the will. If this be so there is now no obstacle in the way of the establishment of the home for orphans in Walla Wallu. The trustees say the legatees will be paid off as rapidly as possible, and that after all expenses connected with tho disposition of their trust have been paid, including $10,000 inheri tance tax, there will remain an en dowment for the home of about $120,-000.
