Motion for a Continuance of James Llnder Case Is Argued Today Father of the Accused Says He Thought Boy Was Free. The trial of Frank Morris, one of the three men who robbed D. B. Richardson's store and safe, nt Helix, on November 10. was called for trial yesterday evening at 4 oclock. Only three witnesses were examined last night The case was concluded tins morning and Morris was found guilty of the crime of burglary and safe blowing. The other two men con- i.ected with the robbery plead guilty and were sentenced to six years each In the penitentiary. Morris hoped to "prove that he was not a member .of the party, when the crime was committed, but that he joined thp ethers later and was only with them temporarily when captured by Slier Iff Taylor near Bingham Springs on the morning following the robbery. His attorneys, Collier and Peterson, n-ade a strong detense, but the evl dence against him was such that the jury was not long In finding him guilty. The case of James Llnder for lar ceny of a horse which has attracted considerable attention on account of the youth of the acused. Is being ar gued this afternoon. The father of Llnder arrived yesterday from North Yakima, and filed an affidavit today stating that he was led to believe his son had been acquitted of the crime for which he was held, and had gone to Minneapolis to live with a sister. On last Friday the father avers, he uas notified that his son's trial was set for the first day of the present session, but that he did not have suf ficient time in which to prepare for defense, and therefore filed through his .attorney, James A. Fee, an appli cation for a continuance of the case. He names several prominent North Yakima business men whose affidav its he can produce at the next term of court, testifying to the previous good character of the accused. Dis trict Attorney Halley will move that the bonds of Llnder be raised to $500 in case the trial is postponed. At the time of going to pi ess the mo tion is being argued. ADDITIONAL BREVITIES. Reese, the barber, wishes to correct the Impression that he Is opposed to the repeal of the law com pelling the Sunday closing of barber shops. To a reporter this mornlnu he emphatically declared that he fa vors Sunday closing. The articles of incorporation se cured by the Sisters of St Francis, authorizes the sisterhood to transact all the business of the academy andd hospital and any other enterprises In which they may engage as one re sponsible head. By the Incorporation the affairs o" the order are simplified and at the same time made more comprehensive.
