This action was commenced for
the recovery of tho possession of a
strip of land in Umatilla county. The
defendant claimed that the boundary
line had beer istablished and he had
been in undisputed and open pos
session of tho strip In controversy
for more than 10 years, but the evi
dence went to show that the line had
never been consented to by the other
party In Interest, except as a tempo
lary line until the true lino could bo
established. The lower court took
from the Jury all the ovldenco relating
to the agreement as to the temporary
character of the dividing lino and told
the Jury that possession, regardless of
such an agreement, could ripen Into
ownership.
