He stated to a correspona- ent of the Baker City Democrat In aa intnrvipw that he had been aware that the action would be filed against him for the past b1x weeks or more, and .that he was in no way alarmed over the outcome of the pending liti gation. "I will admit," said Mr. Smith, "that there Is a silent difference be tween the people who are interested in the Golconda mines and myseit, but it Is nothing like the amount they have asked the courts to compel me to pay them. In fact, all that I owe them is lor pumping the mine for three months prior to the time that I turned the property over to them again. Some time last fall Mr. J. M. English, one of the owners of the mine, offered to Bettle the claim for about $6000. "We considered this an exhorbitant figure and offered in settlement 53100. This settlement was refused. It still stands good, however, the proceeds from the mine In developing It, as against the agree ment in courts will Tequire us to pay more than that amount' "The petition states that you uaed the contract?" was asked. "Of course we used the proceeds In developing the mine. I also put in a large amount myself. We took out about $25,000 -worth of ore from the mine, and I personally put into the company or business about 140,000. Everything was settled last fall with the exception of the amount due the Sumpter people for pumping the mine for three months. . Present Owners of Golconda Are Not in Litigation. The Blue Mountain American, published at Sumpter, explains that the suit now being instituted by the Messrs. English against Charles A. Smith, of New Liverpool, O., who held the property under bond for the period of a year. haB no reference whatever to the Golconda company, now operating the property, nor does It bear in any manner upon the prop erty or officers, except that Smith's conduct when in charge of the mine, before it was purchased by the pres ent owners, is the basis for the ac tion. So far as the present company is concerned, the suit is as an outside transaction, as it cannot affect the mine or company in the slightest de gree. It Is merely .an accounting be tween two-men who were once con nected with the 'Golconda. Thtt nwlrtpnt of -the Golconda com pany is Hon. J. H. From present indications the democratic convention, of the First congressional district in session here today will re sult in the nomination of J. 'W. Spen cer, or Evahsville. The only other aspirant is Thomas H. Dillon, of Pe tersburg. Spencer" represents the conservative element in his party, while Dillon has the backing of the Bryan men.
