Tbat it shall bo unlawful for any penton or porsons living in tlio i counties 01 jjiuiii uiuumiiiiiiBi jiuiimjh) Polk, Washington, Multnomnh Colum bia, Clatsop mid DougluB, in the Stnto of Oregon, who may bo tlio owners of any bull of tlio ago of ono year or moro, to permit tlio eamo to run at largo on tlio commons at any Hoason of tbo year. Sec 2. Tbat it uliall bo lawful for any person or perrons rosiding in either of tlio countioH named in section (1) ono of this Act to l alto up and castrutu or causo to ho ciiRtrated at tlio risk and ox nonso of tlio owner or owners of any bull found running at largo on tlio commons of tbo ngo specified in soctiou ono of this Act, under tlio restrictions as here inafter provided. It hIhuI bo lawful for any ponton or persons, who may find any bull running at large, to take up such nnlmal if at the lime it is known to him or them to bo kept or intended to bo kept for breeding purponos by tho owner or ownom thereof, and to safely keop or cause to bo kept such nnlmal in an on clostiru at tlio cxpontu of tho owner or owners tlioreof. Sec. ft. It shall bo tho duty of any person or persons taking iijf nny animal under the provisions of tills Act to forth with notify tlio owner or owucn of hucIi animal, that bo or thoy bavo taken up such animal, and if at tho time oftaking up any animal under the provisions of this Act tho owner or owners thereof bo unknown, It shall bn tho duty of tbo person or persons taking up suuh animal to advertibo tho sumo in homo newspa per of general uireulation In tho county in whioli bo resides, or by porting writ ten notice in at It'iiet tlireo public places in tbo county, and giving not loss than three weeks' notice; provided, that tho person or persoim taking up hucIi an imal shall give as nearly as possible a true and accurate dihcription of such animal taken up, giving both natural nnd artificial marks, and tbo person or persons taking up any animal under tho piovldions of this Act shall be allowed u reasonable compensation for such taking up, posting and curing for the sumo ; and In case tho owner or owners thereof neglect of refuse to pay tho same, then the person or persons taking up and posting such animals shall have a lieu on tho siiiuu by reason of tho service rendered. See. 0. If, after expiration of throo weeks after published or posting of the notices as required in this Act, the owuuer or owners should fail or neglect to claim such animal and pay tho char ges, it shall Ik lawful for tho pomon or persoiiH taking up such animal tocaiuo tho same to be sold at puhlio auction by tlio constable of tho precinct in which ho lives, or by the sherill'of tbo county in which ho resides, after having given at least ten days' notice of the timo and iilnco where said animal will be oll'ered for sMo. See. 7. Tho ihthoii or persons taking up any animal under tho provisions of this Act shall bo entitled to bid at tbo Mile of miiil animal. The olllcer making Mile of any animal under tho provision id this Act shall make returns to tho utility clerk of tho county in which tho ido vwu made, giving the ibscription of lite animal sold, tho amount for which it Mil I for and to whom, and after tho payment of tho costs of making sale and vxpoiiM) of keeping and care of such an annual from tho proceeds of such side, if any surplus shall remain, to forth with turn overmteh surplus to the coun ty treasurer of his county. See. 8. Tho county treasurer shall receipt tho officer making deposit of any moneys arising under the provisions of Ibis Act and safely keep Haul funds, and upon tho proper owner or owners thereof of any animal that may have Wen Hold under the provisions of this Act, making titlidavlt to tho county treasurer of tho county whoro such dqMsU is made that ho or they wow tho owner of such an imal at tho timo tho sale was made the treasurer hIiuII turn over to suoh ownor or owners the proceeds of such tale as are remaining in his bands ; provided, that such atVhlavic is made within twelve months from the date of sucb sale. Sec. 0. If, after tho expiration of twelve months from ditto of any side as provided for in this Act, any money that may have accumulated in tho liaiuu of tbo county treasurer by hucIi salo or eulos as provided for in section (() six of this Act, and unclaimed as provided in section ol this Act, it shall bo doomed forfeited tq tbo common school fund of tho county, nnd it shall bo tbo duty of tho county treasurer to trtuinfor uld sum to tho school funds of bis county, nnd it shall bo distributed tho samo as provided for tho distribution of tho com mon school fund. That any person, porsons, compnny, or corporation, or lessco or agent thereof, owning or opornting any railrond within tho State of Oregon, Hhall bo linblo for tho vnluo of any horses, colts, cows, bul.'H, or culvos, or sheon killed, and for rousonablo dam ages for any injury to any such livo stock upon or near any unfenccd track of nny railroad in Ibis Stato, wbenovor hucIi killing or injury is cnuscd by nny moving train, or engine, or cars, upon such track. Sec. 2. No railroad track shall bo doomed to bo fenced, within tho mean ing of this Act, unless such track is guarded by such fence against, tbo en trance thereon of any biicIi livo atook on cither Hide of said track, nnd not trnok.iindnot moro than ono hundred 'tit distant therefrom; provided, that whatever is n lawful fence, under tho laws of this Stato, in tbo county whoro Htich killing or Injury Hhall occur, and no other, under tho laws of this Stnto shall bo doomed and bold n lawful fence undor thin Act; and provided furthor, that complete natural dofonces ngnlnst tho entrance of sucb otook upon Hnid track, such oh natural walls or deep dltcboH, Hhall bo deemed and held to bo a fence undor UiIh Act, when tho jsamo in connection with olbor and ordinary lawful fences from a continuous guard and defense against tho entranco of such livo stock upon tbo track. Sec. :i. Wbenovor such livo slock mentioned in section ono of this Act is ho killed or injured upon tbo unfonccd railroad truck of any railroad in this Stato, tbo person, portions, company or corporation owning or operating such railroad or bis or their lessees or ngonts, orsomo proper and authorized ugont employe thereof shall immediately causo to bo tiled a notice of sucb killing or in jury, by filing a concito description of tbo animal or" animnls so killoil or in jured, including any and all brands, ear marks or other imirktiof ownorobip, and if only injured tho nature of such in jure, injury with tho railroad ngonts at tho two extremities of tho Hoction on which sucb killing or injury took placo, and also, with all intermediate agonts on Htich section, said description ahull bo opon to inspection at all renHonablo hours of each week day for ono month after such killing or Injury took placo. Sc. -1. Any person, persotiH, com pany or corporation, or his or their los sees orauthorued agents owing or oper ating any railroad within tho State, who shall neglect or fail to tlio or causo to bo tiled tho notico provided for in tbo pre ceding soctiou of tluH Act, shall bo doomed guilty of u misdemeanor, and on conviction thereof in any court of com petent jurisdiction shall bo lined not less thuu fifty dollars nor moro than two hundred dollars for each olTenso. See. 6 1 u every action or suit for tho recovery of the value of any livo stock mentioned in section 1 of this Act, so killed, orfor damages for injury to tho same, hb hereinbefore provided, proof of such killing or Injury Hhall of itself bo doomed and hold to bo conclusive evidence in any court of this Stato of negligence upon tbo part of tho person, pontons, company or coi'ixmtlion, or his or their lessees or agents owning or op orating sttch railroad; provided, that contributory ncgligenco on the part of the plaintitr in Hiioh notion or suit may lie sot up as a defensn; but, piovided furthor, that tho allowing of stock to run at largo upon common uufeuecd rauge, or upon enclosed land owned or in possesion of the owner of such stock, Hhall not U. deemed or held to bo such ooiuiiliutoiy negligence, frovuleu Mr- lliwr, that in any sticii sun or action proof of wilful interest intent on tbo part of tho plaintitr therein to procure tbo killing or injury of any such stock in tbo manner aforesaid shall defeat tho recovery ol any damages for suoh killing or Injury. Sec. Ik In any suit or notion author ized by this Act, xorvieo ol Biuumons or nny other necessary process may bo made upon any person, persons, com pany or corporation, or his or their les sees or ugonts owning or operating any railroad in this State, by personal service uivon any authorized agent thereof re siding or stationed in tho county where such suit or action is brought. Inasmucb as loss of stock, without adequate means of obtaining re muneration thereof, is of frequent occur rence in this State, this Act shall tako affect and bo in force from nnd after its approval by tbo Govornor.
