cide to opt out of participation in the project decide to
opt out of their contract, they must provide notice to
each affected building tenant 210 days in advance of
ending a long-term contract and 150 days in advance
of ending a short-term contract. The notice needs to
inform tenants:
• Whether the owner intends to withdraw the prop-
erty from the Section 8 program;
• Whether the owner intends to convert the proper-
ty to nonparticipating use;
• Whether the owner is involved in negotiations
with federal or state housing agencies relating to
an expiring contract.
Owners opting out of federal preservation projects
may not disturb any tenancy other than for cause
identified in the contract for 180 days after expira-
tion. The ordinance also stipulates that the Portland
Housing Bureau will assist any tenants who are invol-
untarily dislocated from federal housing properties
with dislocation assistances. The bureau will also ask
owners opting out for voluntary contributions to a
tenant relocation fund.
