such mining claim when the pub

and distances to an approved

failure shall be conclusively
deemed (I) to constitute a waiv
er and .relinquishment by such
mining claimant of any -right,
title, or Interest under such min
ing claim contrary to or In 'con
flict with the limitations or re
strictions specified In section 4
of the Act or July 23, 1955 (0
Stat. 367), as -to 'unpatented
claims located after 'that date,
snd (ll) to constitute consent
by such mining claimant that
such unpatented mining claim
shall be subject to said limita
tions .and restrictions, and (Hi)
to preclude thereafter, prior to
issuance or patent, any assertion
by such mining claimant of ny
right or title to or Interest In
or under such mining claim con
trary to or In conflict with aaid
limitations or restrictions. Sec
tion 4 provides, generally, -that
unpatented mining claims lo
cated after July 23, 1958 shall
not be used for purposes oiner
than prospecting, mining, or pro
cessing operations, or uses rea
sonably Incident thereto: that
such claims will be subject to
Ihe right or the united states
to manage and dispose of the
vegetative surface resources
thereof and to manage other sur
face resources thereof: and that.
except to the extent required for
mlnlog operations and uses rea
sonably Incident thereto or to
provide clearance for such op
erations or uses, claimants of
such claims shall not use or dis
pone of vegetative or other sur
face resources thereof: and that,
except for clearance for such
purposes, any permitted sever
ance or removal of timber must
he in accordance with sound
principles of forest management.
Said section 4 also provides that
any use of the surface of any
such mining claim by the Unit
ed Stales, its permittees or li
censees, shall be such as not to
endanger or materially Interfere
The date of first publication
of this Notice shall be Oct, 3,
1962.
