tain States Power Co.'s suit
for injunction against city en
forcement of an electrical
safety ordinance.
Filed by Atty. William S. Fort,
the answer to Mountain States'
amended complaint of Feb. 11
charged in effect that a city or
dinance passed last fall is valid.
It sets up procedures by which
the private firm a competitor
with Municipal Power must pay
lees for construction work and
maintain certain safety provisions.
Mountain States filed an in
junction suit against enforcement
shortly after passage of the or
dinance. The company terms the
city action an attempt to take
private property without due
process of law in violation of the
Oregon and U. S. Constitutions.
Mountain States charges that
the ordinance is a roundabout
way of trying to force the utility
out of business. It requires the
manager of Municipal Power to
inspect work project applications
and to pass on safety of Mountain
States equipment and operation.
It requires payment to the city of
$1 per pole in fees to replace or
install poles and $5 each for other
work applications.
Among other charges, the
amended complaint filed in Feb
ruary by the company states that
the city has no legaj authority to
regulate a public utllNy, as the
ordinance proposes. The company
says the Oregon Public Utilities
Commissioner is given this power.
Municipal's answer is practic
ally an outright denial of
charges.

After a four-hour wait by official
order, singer Jane Froman was re
united at a hospital Saturday with
her husband, Capt. John C. Burn,
who piloted a plane that carried
52 Easter travelers to death in the
shark-infested Caribbean.
The singer flew in from New
York to see Burn, the central fig
ure of a tragedy reminiscent of
the 1943 crash in the Tagus River
at Lisbon in which Burns saved
Miss Froman's life.
'I am very happy," she said,
after guards finally admitted her.

survivors of a crash Friday out
side San Juan harbor of a Pan
American DC-4 that faltered
when one engine failed after tak
ing off for New York.
She had been barred by order
ot Dist. Atty. Zoilo Dueno Colon,
who questioned Burn about the
crash.
Burn was turned loose after
being held 17 hours incommuni
cado. He left the hospital with
Miss Froman and went to a hotel.
The Coast Guard announced
the search has been abandoned
for the 39 missing passengers.
Thirteen bodies were picked up
near the crash scene. Most of the
victims were Puerto Ricans.
The district attorney said guards
had been placed outside Burn's
door at Presbyterian Hospital for
his own protection. He did not
specify what from.
Burn said he was well, but was
very upset about the tragedy.

Witnesses said Burn helped
launch four life boats before the
