Chapin, 20, a gangling "model boy" who stabbed to death a 14-year-old baby sitter and her 4-year-old charge, was spared the electric chair today because of doubt over hi sanity. Two and a halt days before he could have been executed, the Massachusetts Executive Council, on recommendation ot Gov. Chris- tiun A. Herter, voted M to com mute Chapin's death sentence to life imprisonment. At Springfield, Stephen Gold- School Principal Doubts Indian Boy Set Blaze SAN DIEGO, Calif., Nov. 29 ( A teen-age Indian boy, held on auspicion of starting the Cleveland National Forest fire, wag de scribed by his high school prin cipal today as "a sad little char acter." . The school principal added that he doubted it the boy, Gilbert Paipa, set the fire. Elwood Stone, ' investigator for the VS. Forest Service, said Paipa told him yesterday: "I just got a crazy idea to throw a match in the grass to see if it would bum." : The fire, which broke out Satur day spread with terrific fury over 44,000 acres and burned 11 fire fighters to death. It was still smouldering today and foresters were on watch against a possible new outbreak as dry northeast winds increased and humidity remained low. . .. Flaren Checked A flareup three miles north of El Capitan reservoir along High way 78 was checked at 1:30 a.m. The Indian boy was In Juvenile custody ' while federal and state officials conferred on disposition on the case. Dist. Atty. Don Keller said he was held as a Juvenile but could be prosecuted, it circumstances warrant, in adult court. Keller said the account of his alleged confession indicated possi bility of prosecution on charges of arson or manslaughter. The boy, dressed in denim trou sers and leather jacket, had little to say himself. Prrsnasloa Passible Ray Redding, his principal at Julian Union High School, said Gilbert could have been parsuad ed by some older person to take responsibility for the fire. He said the youth. In first year of high school through a "social promotion," had a low I.Q. and could barely read and write.' The principal said he was fail ing in every subject except physi cal education. He described the boy as shy but not sullen and said his age was in doubt. He was booKcd as It. Moyna han, who prosecuted Chapin and opposed commutation could not be reached. Warden Achuff said Chapin would be moved from the death house upon instructions front the commisioner -of correction. . The Council action came a day after Dr. Fredric Wertham, con sulting psychiatrist to the New York City Department of Hospi tals, told it that Chppin Is legally insane a typical case of schizophrenia split personality" who lacked ability to tell right from wrong. The vote reversed an earlier re fusal of commutation seven months ago. Three - councillors who voted against commutation then switched to the other side to day. Two said grave doubts had arisen in their minds. The third said that en the testimony of a state psychiatrist that Chapin was a goof he would not vote for the electric ' chair.. Cal Tech Traces Major! Earthquake 5,900 Miles West PASADENA, Calif. Nov. M W The selsmogological instruments at California Institute of Techno! ogy recorded a major distant earthquake at 1:27.52 a.m. today Dr. C. F. Richter said the shake came from approximately 5.900 miles to the west of here and was of the magnitude of seven. He said any quake registering a mag nitude of seven or more is con' sidered a major one, capable of causing considerable destruction in a populated area. 4 Dr. Richter said this was the first major quake recorded from any place in the world since last Oct. 24. He said there was a smaller quake yesterday, which besan re cording at 11:37.41 a.m. from distance of about 4.400 miles in an undetermined direction. The mag' nitude was 6.1.
