Book Law on
Obscenity
Called Vajmer
Attorney for indicted book
dealer Claude Cummin gs said
Tuesday that Oregon's law gov
erning sale of obscene literature
was unconstitutional because of
its vagueness, in arguments be
fore Marion County Circuit Judge
George R. Duncan.
Judge Duncan beard arguments
from Defense Attorney Bruce Wil
liams and District Attorney Ken
neth Brown on both sides of the
case and began study of briefs
offered to support the arguments.
He declined to speculate en when
be would reach a decision on the
demurrer filed by Williams chal
lenging the constitutionality of the
law under which Cummings was
: arrested. .. ... '...:
Cummings, head of the Salem
Newt Agency was indicted as the
result of a grand jury investiga
tion into the sale of alleged ob
scene literature on county news
stands. Jack St. Clair, of Ameri
can News Agency, has been in
dicted on the same tharge.
Attorney Williams attacked the
constitutionality of the law Which
prohibits sale of the literature on
the basis that its vagueness did
not permit base for law. D. A.
Brown argued that the intent of
the law was clear in support of
the Indictment of the two men.

Rail Charge
Hearing Set
A public -hearing will be- held on
an application by the railroads for
increased demurrage charges, Pub
lic Utilities Commissioner Charles
H. Heltiel said Tuesday. No date
has been set.
The higher charges will not go
into effect pending the hearing.
. Demurrage charges are fees
which shippers and receivers must
pay while freight cars are being
loaded or unloaded.
Present demurrage charges are
$3 a day for the first four days,
and $6 a day for each day after
that. The railroads want to collect
$4 a day for the first two days, 7
for each of the next two days, and
$10 for each subsequent day.
The railroads also would charge
for Sundays, Saturdays and bolt
days, which now are free days.
A similar application is before
the inter-state Commerce Commis
sion. -,
