claimed the hero of a legendary
nestero saga.
Maurice Smith, who 54 years
ago blocked killer Harry Tracy's,
rcijn o( terror in the Northwest,
died at Brinnon, Wash., on Hood
Capal. He was (1.
In later years Smith served
as a member ol the State Legis
lature, on the Spokane City
Council and as a Mate Liquor
Control Board examiner.
But he is best remembered for
his part in a gun fight on a;
sultry afternoon in an Eastern
Washington barley field.
Met and Taught
There Smith- succeeded where
scores of law officers and count
less soldiers failed. This is the
story of how Maurice Smith and
Harry Tracy met and fought.
The date is June 9, 1902. Two
convicts had scaled a wall of
the Oregon State Penitentiary
and vanished in the -warm spring
rain.
Behind, two prison guards lay
dead. A third Is dying - after
being shot off the wall.
In the thick woods, Harry
Tracy and Dave Merill, the
escapees, ran frantically, crad
ling smuggled rifles. Both had
been serving time for armed
robbery.
Miles Away
Miles away from the scene, a
young lawyer. Maurice Smith,
went about his businessuna
ware of his approach with fame

The. escape touched off one of
the most intensive manhunts in
the Northwest. Merill and Tracy,
meanwhile, were working their
way towards the Columbia
River. They walked boldly Into
farm houses, announced who
they were, and forced farmers
to feed them.
The desperate killers com
mandeered horses, clothing and
more guns while calmly eluding
four companies of Oregon militia
and numberless posses.
After the pair forced a farmer
to row them across the Colum
bia, the bond between the con
victs was abruptly parted. Tracy
shot his partner (or having in
formed upon him several years
before.
Tracy Now. Alow
Alone, Tracy made his way to
Olympia, stole a tug boat and
cruised to Seattle, where he
openly taunted the law and killed I
several mure men in peraning
from two' bitter gun battles
Tracy roamed south of Seattle
briefly, stole more horses, then
headed over the Cascade Moun
tains to Wenatchee, where he
again began his farmhouse ter
rorizing. Tracy pressed on across the
Eastern Washington prairies.
His destination was "hole-in-the-wall,"
a Wyoming wilderness
and haven for badmen.
The posses pursued him.
. Near the little town of Creston,
SO miles west of Spokane Tracy
made a mistake. It was to cost
him his life.

Shows Gain
The current traffic count at Mc
Nary Field in three days
ceeded the entire week's total of
the count taken last September,
John Evans of Portland said Tues
day night.
With 107 takeoffs and landings
counted Tuesday, the three -day
count was 832, substantially higher
than the 762 seven-day total last
fall, the. Civil Aeronautics Admin
istration representative said.
Pilots itching all winter for a
slice of that wild blue yonder made
533 takeoffs and landings Sunday.
The count was 192 Monday.
Tuesday's operation was more
like last fall, when the average
daily count was 109 and the high
est for the week was 209.
Flyers are hoping the count this
spring will be high enough to rate
a CAA control tower for McNary
Field. Ceiling and .visibility re
quirements for flying are lowered
for fields with control towers.
Fire Destroys
Warehouse
At Pendleton
PENDLETON, Ore. 0T1 - A
fire . destroyed - the - Morrison
Knudsen Co. warehouse and shop
at Barnhart, eight miles west of
here, early Tuesday, and a few
hours later another blaze des
troyed the Pendleton city main
tenance shop.
Both fires were of undeter
mined origin. No one was injured
in either blaze.
The loss at -the city building
tentatively was estimated at
$30,000 by City Manager Walter
Crook. He said the building was
insured.
Merlin Young, Morrison-Knud
sen division office manager, said
loss at the Barnhart building
could not be determined for
several days. He said the build

But the frightened boy did talk.
And soon a five-man posse set
out to bring down Tracy.
The heat clung to the farm as
the men closed in. Tracy, with a
full stomach and a bed. lost his
sharp edge of awareness.
Maurice Smith, a veteran of
the recent Spanish - American
war. Ctei upon Tracy to sur-
render when the ' killer walked
out of a barn.
Tracy ducked back into the
building, grabbed a gun and ran
for a dry, shallow gully that
sliced through a creekbed.
Guns blazed. Then Tracy made
his last desperate bid for free
dom down the gully.
Slowly, Calmly ...
The lawyer, fired slowly and
calmly. He saw little puffs of
dust kick up around the fleeing
killer. Then there was no puff
of dust.
The posse closed in hearing a
final muffled shot.
They found Tracy a n d
clutched to his breast was the
rifle with which he had killed
nine men the last one was
Harry Tracy.
Smith's last shot shattered the
killer's ' leg. - The manhunt was
over and Tracy's body was taken

NEW YORK I - The steels and
a handful of blue chips stood out
strongly Tuesday in a mixed stock
market.
The Associated Press average
of 60 stocks was up 80 cents at
$189 80, another new record high
mark for the average.
Industrials were at a new high
of $272.80 with a gain of $1.60,
railroads were the highest since
1929 op 50 cents at $144.20, while
the utilities backed down 10 cents
at $74.80.
There were 1,193 individual
issues traded of which 453 ad
vanced and 527 declined with 99
new highs and 9 new lows for the
year.
Volume was substantial at 2.960,
000 shares as compared with 2,
570,000 shares traded Monday
when the market also hit a new
high mark.'
