Senate'Confirms
Judge Harlan for
High Court Seat

ate Wednesday confirmed Presi
dent Eisenhower's nomination of
Judge John Marshall Harlan to be
a justice of the Supreme Court.
The vote was 71-11.
Harlan, 53, now a judge of the
Second U.S. Circuit Court of Ap
peals in New York, was nominated
last November to fill the Supreme
Court vacancy left by the death
ef Justice Robert H. Jackson.
Harlan's nomination was ap
proved after wide-ranging denun
ciation that hit the court itself and
the United Nations".
Nine Democratic senators and
two Republicans, Sens. Langer of
North Dakota and Welker of Ida
ho, voted against, confirmation.
The Democrats, all Southerners,
were Sens. ; Eastland and Stennis
of Mississippi, Ervin of.North Car
olina, Hill of Alabama; Olin Johns
ton and Thurmond of South Car
olina, McOellan of Arkansas, Rus

ternationalist" background. They
said they feared he might hold that
the United Nations charter- or
other treaties could override the
constitution and domestic law.
Harlan himself testified, how
ever, that he was "not a one-
worlder" who believed in the sur
render of American sovereignty to
an international organization. He
said that as a member of the court
he would enforce the constitution
and the laws made by Congress.
Johnston, announcing his deci
sion to vote against nomination.
said Harlan "might make an able
judge" in "some respects but
that his failure to clarify his po-
sition on certain questions raised
during the confirmation hearing
compelled him to oppose the nom
inee.
Eastland, assailing the nomina
tion on several counts, objected
that Harlan "would not give his
views on treaty law." He said the
judge was supported by "pressure
groups advocating world govern
