Fifth Circuit Court of Appeals Fri
day upheld a lower court decision
denying an English dancing in
structor damages against the Hous
ton (Tex) Chronicle.
The instructor, Eveline McCul
lagh of Great Britain, sued the
newspaper alleging she was libelled
and that her privacy was invaded
ha atnrv and cartoon carried
after she had filed suit against the
Houston Transit co. because ot a
hits mishan.
The appellate court opinion said
Miss McCullagh suffered a minor
injury while riding' the bus and
aued the company lor suz.ra.
The anneals court laid the dan
cer objected to a Chronicle story
nn ih auit which bore the head
line "asks $132,500 for unreasont
able jerk, bus skips, dancer nips,
suit nips." She also complained of
the following paraseoiogy in u

"A Houston Transit Co. bus that
did the boomps-a-daisy when it
should have been doing a smooth
waltz caused a 45-year-old English
dancing teacher to file a $132,500
damage suit in federal court bat-

very ungraceful adagio flip' half
way up the aisle of a jerky bus..."
The lower court sustained the
Chronicle s motion to dismiss the
suit on the ground that the petition
failed to state a claim upon which
relief could be granted.
The anneals court ODinion said
"The appellant does not allege
(hat tha article imneached or in
jured her reputation, and there is
no allegation that it Impeached her
honesty, integrity, or virtue. She
alleges only that such caricature
and article were defamatory of
her, held her up to ridicule, and
were libelous because of such fact
"A careful examination ot the
publication complained of convin
ces us that it fails to contain any
thing that is defamatory or has a
tendency to injure the appellant's
reputation. It may be that she has
been made the subject of some
ridicule, but, according to Texas
law, this does not give rise to a
cause of action to libel . .
"The law of Texas does not rec
ognise, a cause of action for a
breach of a right of privacy."

Move Higher
CHICAGO un -JThe little bull
market in wheats a performance
which has been going on in the
wings while the big bull market in
stepped right out in front of the
audience this week.
Wheat swirled sharply higher,
outstepping soybeans in the
amount of gain. New crop futures
made new season peaks on sev
eral days, ending only slightly be
low their highs. Corn and lard
firmed but oats and 'rye were
mixed.
Wheat closed the week 4tt 7tt
higher, corn l't-3 higher, oats
lower to 1V higher, rye
lower to V higher, soybeans V
IVt higher and lard It to SO cents
a hundred pounds .higher.

Rises, Falls
NEW YORK () The stock
market inched up to a new 24-year
high this week and then retreated.
With only a gentle nudge, the
market as measured by the Asso
ciated Press average of 60 stocks
broke through a new ;953-54 peak,
highest level for the average since
1930.
Professional traders took the
whole thing in stride.
Many in Wall Street felt, how
ever, that the general investing
public 'might attach weighty signif
icance to the new record and come
rushing into the market
Brokers were quick to caution
their customers with the old Wall
Street reminder you don't buy
the stock market, you buy stocks.
And they were highly selective in
their suggestions for purchases
and sales of securities.

Airlines is in the monkey business
and not happy about it.
It has 10 pig-tailed macaques
from India on its bands.
"They're waifs, like babies on a
doorstep," said C. E. Bartholomew,
TWA cargo sales manager here
"If someone bids me S45, he's
bought a monkey.
Mrs. Lloyd L. Brown, Overland
Park., Kan., ordered the monkeys,
specifying the little ones, not more
than two pounds each, she said.
"But when I went down there to
pick them up, my gosh, some of
those things were half as big as
I am," she explained. She declined
to pay the freight bill of $330.
In the meantime TWA is board'
ing the monkeys at the Swope
Park zoo and hoping someone will
buy them.
What can you do with a pig-
tailed macaque? Well, as for the
uttle ones, Mrs. Brown says:
"They have a short, useless tail
which a vet can remove and you
dress them in size 10 doll clothes.
They walk upright and look just
darling, like miniature chimpan
sees."
