Segregation
In Cafes Ruled
Against Law
Requiring Negro patrons to sit
on one side of a ; cafe while the
other side is reserved for the
white race is contrary to the Ore
gon civil rights act, provided
such distinction is on account of
race, religion, color or national
origin and constitutes a denial
of full and equal accommoda
tions, Attorney General Robert
Y. Thornton held Friday.
The opinion was requested by
Ulysses Plummer Jr., of the fair
emplyoment practices division
advisory board.
"Under the Oregon act a res
taurant, unless in its nature dis
tinctly private, is a place of pub
lic accommodation and the is
sue resolves itself into one of de
termining whether or not such
segregation is a violation of the
Oregon law, Thornton wrote.
The attorney general quoted a
Michigan supreme court opinion,
based on a civil right act some
what similar to the Oregon law,
which held all persons are en
titled to the full and equal ac
commodation at enumerated busi
ness establishments, including
restaurants.
The Oregon law bans restaur
ants, hotels and other places
serving the public from dis
crimination against any person
because of his race, religion, col
or or national origin.
Persons discriminated against
under the Oregon law can sue
for up to $500.
