The court order settled a dam age suit brought Sept 15 by Pay Less Drug Store of Salem against the food market The drug store sought $25,000 damages and an injunction pre venting the use of the .name Pay Less. Defendants in the suit were Eugene W. Martsfield, Vernon D. Tracy and Sam Blis chke. Judge Kimmell ordered the defendants not to use the name Pay Less in Salem or in the sur rounding trade area in connec tion with their business. Stone, health officer, for the period Sept 19-26. The city also listed two cases of impetigo and one of syphilis. The rest of the county reported one case of dog bite, one of impetigo and one of mumps. State institutions reported one new case of syphilis. Proposal Plan On Mall Work Coming Soon A proposal for preparing the plan for developing the state capitol mall will be worked out soon by Francis Keally, New York City architect, he told State Treasurer Sig Unander on the latter's recent business trip to New York City. Keally drafted the plans and specifications for the Oregon state capitol. Unander, back in Salem Tues day, said Keally still feels that the proposed new state supreme court building should be located across Summer Street south of Union Street and face the state capitol. In addition, Unander said, Keally would submit a general plan for future development of the mall during the next 50 years and a more extensive plan cov ering a period of 100 years. "I believe it would be advan tageous to the state to accept Keally's ideas," Unander said. Keally has set $50,000 as his fee. The board of control prob ably will ask the attorney gen eral for an opinion to determine if it can pay him $50,000 out of a $400,000 appropriation of the 1953 legislature to acquire addi tional property in the capitol area. If this can not be done legally the board of control would be required to go before the emer gency board . and ask an appropriation. $46,036 Low Bid on Bridge P. S. Lord Co. of Portland submitted a low bid of $46,036 for construction of a bridge over Pudding River nea,r Pat's Acres, the State Highway Department aotified Marion County Court Tuesday. Marion and Clackamas counties will split costs of the bridge which has a main span of 100 feet of steel girder construction. Approaches will be of timber with treated piling. The two county courts will hold a conference on the bid which was well under the highway de partment's estimate of $48,445.
