Fines and sentences growing
out of the arrests totaled $28,174
and the violators were given

The state supreme court handed
down a formal decision Thursday
ruling that the Salem Electric
franchise initiative should appear
on the Salem city ballot Novem
ber 2.
Last Friday the court ruled or
ally that the measure should re
main on the ballot, but Thursday's
opinion gave reasons for the deci
sion, j
The suit, j brought in Marion
county circuit court by Portland
General Eleekric company, sought
to enjoin County Clerk HarJan
Judd and other county and city
officials from placing the fran
chise proposal on the ballot. The
measure would give Salem Elec
tric, a cooperative, an unlimited
franchise to supply power in Sa
lem, j
The opinion was written by Jus
tice James T. Brand, and said
Circuit Judge E. M. Page ruled
properly when he dismissed the
suit It ruled that PGE had no le
gal capacity to ask for an injunc
tion, stating that it is the duty of
the district attorney to bring such
a suit.
PGE claimed the cooperative
failed to comply with the proce
dure in distributing and filing in
itiative petitions. It further claim
ed that competition with the co
operative would hurt PGE, but the
court said this claim could not be
considered.

Salem on a charge of larceny by
Marion County Sheriff Denver
