Plans Laid for Santiam Forks
Water Control District; Meet
Scheduled at Albany Aug. 12
Landowners in the Santiam river region, of Southern Marion
county and northern Linn county are organizing to -prevent further
damage by flood, and to improve the agricultural uses of their
properties, by taking first steps toward creation of a water con
trol district.
A petition requesting the Linn county court to order the organ-
of the Santiam Forks
ization
water control district has been
filed with the Linn county clerk
by 25 Marion county and 133
Linn county residents who hope
to include, about 16,520 acres of
land within the district's boun
daries. The first hearing of the
petition is7 scheduled August 12
at 10 a.m. in the county court
room at Albany, and all persons
interested in the organization of
the district or the fixing of its
boundaries are asked by public
notice to attend.
The petitioners state that they
own more than 20 per cent of the
acreage of the land lying within
the proposed boundaries, have
raised $1,000 to pay court and
organizational costs, and are en
titled by a new water district
law passed by the 1947 legisia
iure to propose this district.
They intend to riprap, clean
channels and construct dikes, and
to contract with a federal or oth
er agency for building and main
taining drainage, irrigation or
flood or surface water control
works. The petition states that
substantially all of the land with
il the boundaries will be bene
fitted by such construction.
, According to the 1947 law, the
Linn county court will have juris
diction over all lands in the dis
trict without regard to county
lines because 15,060 acres of the
proposed district, by far the larg
est share, lie in that county.
Unless voters representing 20
per cent of the acreage ask for
an election (thus indicating oppo-
sition), the county court of Linn
after the hearing can create
the district and ask the land
owners to elect-a nine-man board
of directors to manage the affairs
of the district.
A water control district is de
fined by law as a governmental
subdivision of the state and a
public corporate body whose
rights include sale or lease of
water for irrigation, levying of
ad valorem taxes, creation of
special assessment districts, bor
rowing money, acquisition of
property, the right to contract
and td handle all works and im
provements. Washington Girls
