The rommunitv property law. which would revise basic Oregon
law to five wives, for purpose of taxation or divorce, an equal share
of hu.bands' earning, p;sed the senate Thursday (18-11) and was
sent to the house.
The bill, which would replace the present common law which
make the husband the Mile owner of any earnings or property not

both opponents and proponent

mimmanzed the effect. of the bill
in three points at the Mart of the
four-hour debate. vmg the bill
would:
(1) Grant equality to hubcnds Oregon law and hundreds of
and wie in the eyes of the law. ccurt decisions ould be discard-

; Sen. W. W. Baiderree of Grants

many members of the legal pro-fesM-n
were simply aliaid to
make the change and charged, in
icply to. Sen. Thomson's htate
ment. that cor!fuion woula re
I suit, that even under the present
1 law many points of difference
arie.
Law Prefessers Q acted
Arguments on the second point,
that neigi Jboring states have had
the law Icr many years, centered
aiound quotations from law pro
fesors and lawyers from other
states both: favoring and opposing
the community properly plan.
Sen. Austui Dunn of Baker, who
studied in Washington under the
proposed system, stated that law
yers who are working under the
communal ystem- do not under
stand it, while proponents of the
bill asked n hy there h been no
move in these states to change
the law.
Sens. Frank Hilton of Portland
and Doug McKay of Salem cited
instances where prominent busi
nessmen hae moved their homes
and businesses from Oregon to
Washington to come under the
communal plan.
As to po-ible savings afforded
federal income taxpayers under
the plan, conflicting estimates
langed from $15,000,000 sav
ing to the people" by Sen. Wal
lace to. "loss ot S2.4OO.0O0 in rev
enue to the state"' bv Sen. Rand.
4S.M Would Be Affected
Both proponents and opponents
agreed that only 48.000 persons in
Oregon, in the higher income
brackets, would have their fed
eral income taxes reduced mate-'
rially under the plan. Sen. Rand
stated the plan would result in a
$2,000,000 los in income tax and
a $400,000 loss in inheritance tax
reenue yearly to the state. Sen.
Hilton suggested that some of the
savings in ledeial income taxes
could be diverted to the state by
increasing the state income tax
by 1 per cent.
Those opposing the measure
were Sens Belton. Dunn, Fatland,
Jone-. Parkins. Pearson. Rand.
Thompson. Walker. Walsh and
Zurcher. Sen. Cornett was ab
sent. A timilar plan, which was
passed by the 1943 legislature and
repealed to years later after a
like law had been declared un
constitutional, would hae permit
ted families to be included under
the community property law on a
voluntary basis.

HONOLULU. March 20 A)The

who abandoned the tanker Fort

aline. A total of 19 destroyers
originally left Pearl Harbor to
take part in the search with the '
