Wednesday at Enrol Flynn's trial
on three counts of statutory rape
that she has undergone an opera
tion and the prosecution stipulat
ed that the surgery was an abor
tion. '

She has been given to under
stand that at her request no ac
tion will be taken against the man
responsible for her operation, j I

ies and visiting hotel cafes. She
took a 10-day trip to San Fran
cisco, which she explains was
made at the personal expense of
the policewoman attending her. J

cations for employment at night
clubs and in the movies, and car
ries a driver's license giving her

cause the accusation was untrue.
That her entertainment with po
licewomen included night clubs or
drinking.
Did you ever talk to anyone
in authority with relation to: any
operation you have had?" Giesler
asked; . .
"Yes, sir, she answered, i and
replied, to another question, that
a particular man was involved, f
"Did you not request the district
attorney's office not to prosecute
that man?" "Yes sh"
"And did they not promise you
that they would not prosecute that
man if you would testify in this
case?" "No sir.' i
"They indicated that they would
not prosecute that man?" They
told me it would not be brought
up.
Miss Satterlee, who . came to
court on one day early in the case
wearing pigtails, , as a composed
but intently serious witness as she
admitted that she knew the opera
tion was a criminal act, subjecting
her to possible prosecution.
Giesler brought out that in Aug
ust, 1941, the day after she and
her mother made their first Com
plaints to the district attorney
against Flynn, they were instruct
ed to return to juvenile hall the
following day but went, instead,
to Santa Barbara and later to
Eugene, Ore., where Peggy went
to work in a theatre. She said
she believed she gave her age
as 18.
"When you went to Oregon, did
your mother buy you a consider
able amount of new clothes?"
Giesler queried.
State objections were upheld
before she had time to answer.
Returning to Hollywood, she
said she went to work in a night
club on swank Sunset strip.
"What age did you give? ask
ed the attorney.
"I don't remember, I believe it
was 21.
Statutory rape involves a sex
ual act with a girl under the age
of 18. Miss Satterlee has charged
Flynn with intimacies on two oc
casions during a. cruise to Santa
Catalina island aboard the actor's
luxurious yasht. The third count
against him was signed by Betty
Hansen, 17-year-old former Lin
coln, Neb, kirl who worked as a
waitress in Hollywood before she
met Flynn. if7'
Giesler asked her about em
ployment at another cafe. There,
she said, she 'told them she was
18. She said she showed the driv
er's license on which that age
