Widening Denied The county
court, reporting Thursday on an
inspection of the Boedigheimer-
Spinner-Oak Glen road north
west of Stay ton, said through
Judge Grant Murphy that traf
fic and expense involved would
not justify a request for widening
of narrow sections of the" route.
Brush that has grown out along
the road will be removed as soon
as a new brushing crew is form
ed, he said. Commissioner Ralph
Girod said a county crew had just
finished clearing away a small
slide on the Little North fork,
Santiam river, road. There may
be additional slides on this road
before the summer dry season,
the court predicted.

Salem chamber of commerce,
has called a special meeting for
this afternoon at 3 o'clock, at
which several matters pertaining
to the welfare of the Salem com
munity will come up.
Members of the board of di
rectors have not said specifically
what the meeting Is about, but
subjects discussed will concern
expansion of chamber r activities
and Corvallis cantonment mat
ters, Including transportation and
the question of lower freight
rates for the community, it is re

Forty steam locomotives and
30 diesel -electric switch engines
were ordered ; by the Southern
Pacific company - Tuesday at a
total cost of approximately $12,
000,000 A T. Mercier, president,
announced. Deliveries are expect
ed to start in October.
The new motive power, Mer
cier said, is being purchased in
anticipation of still heavier war
time demands upon the railroad.
Since 1939, he pointed out, the
company' has received or ordered
253 steam and diesel. engines, the
purchases starting . well t in ad
vance of the national defense
program. .
Of the steam locomotives in
the present order, 30 will be of
Southern Pacific's articulated
consolidation .type, among ' the
most powerful in the world.'
The other 10 steam engines will
be of the famous "Daylight'
streamlined type for' passenger
and fast freight service.
The . diesel-electric switchers
will be of 1000 horsepower, for
general, use. in the railroada
principal terminals.
When delivery is made on the
new order the motive power on
Southern Pacific's Pacific lines
will have almost twice the trac
tive effort of that in service on
Pacific lines in World war I, it
was stated. .
Deliveries are now under way
and will be -completed by Aug
ust, 1942 on more than $12,000,-
000 worth of locomotives pur
chased ' by Southern Pacific"' last
year. This equipment is to in
clude 40 articulated-consolidation
locomotives, 10 streamlined
"Daylight" engines, and 23 die
sel-electric switchers.
Appeal Denied
Mrs. Garner
The state supreme court Thurs
day denied an application of Mrs.
Myrtle Garner, convicted ' of 'cat
tle thefts" in Curry county, for
appeal of her case to the United
States supreme court. She is .un
der four years penitentiary sen
tence.
After serving several 'months
in the penitentiary, Mrs. Garner
was released on a habeas corpus
proceeding filed In Circuit Judge
L. H. McMahan's court here.
Judge McMahan said she was be
ing held Illegally for the reason
that no women were included In
the Curry county jury panel.
The state supreme court later
reversed Judge McMahan's de
cision and ordered Mrs. Garner
returned to the. custody of prison
officials.
Mrs. Garner sought to appeal
from this decision to the United
States supreme court.
