Decision in
Tazwell Case I
Is Expected
An opinion in the suit brought
by Newton C, Smith, Portland at
torney, challenging the right of
Probate Judge George Tazwell of
Multnomah county - to continue in
office until the next general elec
tion, probably, will be. handed
down by the state supreme court
here next Tuesday, it was report-
ed Friday. ; :
Arguments of attorneys in
volved In the proceeding were
heard by the supreme court two
weeks ago.l ; v
Judge John Mears defeated
Tazwell for the office at the last
general election but he died be
fore qualifying. Governor Charles
A. Sprague then appointed Smith
to succeed Tazwell, but the latter
declined to relinquish the office.
Attorneys for Tazwell argued
that he was entitled to continue
in office under a constitutional
provision to the effect that all of
ficials, other than members of
the legislature, shall continue to
serve until their successor has
been elected and qualified.
Smith's counsel contended that
Tazwell was elected for a defin
ite term of six years and that his
term of office expired on Janu
ary 1 of this year.
