Two Legal Technicalities
Arise Over Situation
in This County
District Attorney William H.
TrLadle yesterday was considering
the legal technicalities la the ap
pointment of Harry Riches, as
county agent for Marlon county.
Two phases of th proposition
are understood to be before the
district attorney for opinion. The
first is whether or not the hold
ing of the post of captain in the
national guard would, prove a
technical barrier to the appoint
ment and the second was the
guaranteeing of federal funds,
providing the county underwrites
the 32,500 project.
Riches, who has held the post
of captain in the national guard
for some lime, receives compen
sation for services during the an
nual encampment ot the organis
ation, but it is not believed that
this can be construed as a lucra
tive position. The question was
raised as one. which, might prove
embarrassing if a legal opinion
was not obtained. -
The constitution provision
states: "No person holding a lu
crative office or appointment un
der the United States, or under
this state, shall be eligible to a
seat in the legislative assembly;
nor shall any person hold more
than one lucrative office at the
same time, except as in the con
stitution expressly permitted;
provided the offices In the mil
itia, to which there is attached no
annual salary,' and the office of
postmaster where the compensa
tion does not exceed $100 per an
num, shall not be deemed lucra
tive."
Militia officers receive quarter
ly pay, it is reported, for services,
receiving some from both state
and government. Informally Dis
trict Attorney Trlndle expressed
the opinion the office could not
be construed as lucrative.
The second question facing the
district attorney is the definite
guarantee by the government that
federal funds will be available
for the post if the county under
writes the program. It was re
ported that the county was to be
reimbursed by payments of 31.-
000 each from the wheat control
and the hog and corn control or
ganizations and $500 from the
dairy control committee, when
these groups are finally fully or
ganized.
The new county agent confer
red yesterday with officials at
Oregon State college. Meetings
with the hog and corn growers
are expected to be conducted ear
ly next week. Riches reported.
